DEFINITION OF UNITED STATES VIRGIN ISLANDS 1 BUSINESS. 2 Section 3 of the Small Business Act (15 U.S.C. 632) 3 is amended by adding at the end the following new sub- 4 section: 5 ‘‘(ee) UNITED STATES VIRGIN ISLANDS BUSINESS.— 6 In this Act, the term ‘United States Virgin Islands busi- 7 ness’ means a small business concern that has its principal 8 office located in the United States Virgin Islands.’’. 9 SEC. 3. SMALL BUSINESS CREDIT FOR UNITED STATES VIR- 10 GIN ISLANDS BUSINESSES. 11 Section 15 of the Small Business Act (15 U.S.C. 644) 12 is amended by adding at the end the following new sub- 13 section: 14 ‘‘(w) SMALL BUSINESS CREDIT FOR UNITED STATES 15 VIRGIN ISLANDS BUSINESSES.— 16 ‘‘(1) CREDIT FOR MEETING CONTRACTING 17 GOALS.—If an agency awards a prime contract to 18 United States Virgin Islands business during the pe- 19 riod beginning on the date of enactment of this sub- 20 section and ending on the date that is 4 years after 21 such date of enactment, the value of the contract 22 shall be doubled for purposes of determining compli- 23 ance with the goals for procurement contracts under 24 subsection (g)(1)(A)(i) during such period. 25 VerDate Sep 11 2014 01:09 Jun 02, 2018 Jkt 079200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5929.IH H5929 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 5929 IH ‘‘(2) REPORT.—Along with the report required 1 under subsection (h)(1), the head of each Federal 2 agency shall submit to the Administrator, and make 3 publicly available on the scorecard described in sec- 4 tion 868(b) of the National Defense Authorization 5 Act for Fiscal Year 2016 (15 U.S.C. 644 note), an 6 analysis of the number and dollar amount of prime 7 contracts awarded pursuant to paragraph (1) for 8 each fiscal year of the period described in such para- 9 graph.’’. 10 SEC. 4. PRIORITY FOR SURPLUS PROPERTY TRANSFERS. 11 Section 7(j)(13)(F) of the Small Business Act (15 12 U.S.C. 636(j)(13)(F)) is amended by adding at the end 13 the following new clause: 14 ‘‘(iii)(I) In this clause, the term ‘covered period’ 15 means the period beginning on the date of enact- 16 ment of this clause and ending on the date that is 17 3 years after such date of enactment. 18 ‘‘(II) The Administrator may transfer tech- 19 nology or surplus property under clause (i) to a 20 United States Virgin Islands business during the 21 covered period if the such business meets the re- 22 quirements for such a transfer, without regard to 23 whether such business is a Program Participant.’’. 24 VerDate Sep 11 2014 01:09 Jun 02, 2018 Jkt 079200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5929.IH H5929 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 5929 IH SEC. 5. CONTRACTING INCENTIVES FOR PROTEGE FIRMS 1 THAT ARE UNITED STATES VIRGIN ISLANDS 2 BUSINESSES. 3 (a) IN GENERAL.—Section 45(a) of the Small Busi- 4 ness Act (15 U.S.C. 657r(a)) is amended by adding at 5 the end the following new paragraph: 6 ‘‘(3) UNITED STATES VIRGIN ISLANDS BUSI- 7 NESSES.—During the period beginning on the date 8 of enactment of this paragraph and ending on the 9 date that is 3 years after such date of enactment, 10 the Administrator shall identify potential incentives 11 to a covered mentor that awards a subcontract to its 12 covered protege, including— 13 ‘‘(A) positive consideration in any past per- 14 formance evaluation of the covered mentor; 15 ‘‘(B) the application of costs incurred for 16 providing training to such covered protege to 17 the subcontracting plan (as required under 18 paragraph (4) or (5) of section 8(d)) of the cov- 19 ered mentor; and 20 ‘‘(C) such other incentives as the Adminis- 21 trator determines appropriate.’’. 22 (b) DEFINITIONS.—Section 45(d) of the Small Busi- 23 ness Act (15 U.S.C. 657r(d)) is amended by adding at 24 the end the following new paragraphs: 25 VerDate Sep 11 2014 01:09 Jun 02, 2018 Jkt 079200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H5929.IH H5929 pamtmann on DSKBFK8HB2PROD with BILLS 5 •HR 5929 IH ‘‘(4) COVERED MENTOR.—The term ‘covered 1 mentor’ means a mentor that enters into an agree- 2 ment under this Act, or under any mentor-protege 3 program approved under subsection (b)(1), with a 4 covered protege. 5 ‘‘(5) COVERED PROTEGE.—The term ‘covered 6 protege’ means a protege of a covered mentor that 7 is a United States Virgin Islands business.’’. 8 SEC. 6. ADDITIONAL MENTOR-PROTEGE RELATIONSHIPS 9 FOR PROTEGE FIRMS THAT ARE UNITED 10 STATES VIRGIN ISLANDS BUSINESSES. 11 Section 45(b)(3)(A) of the Small Business Act (15 12 U.S.C. 657r(b)(3)(A)) is amended by inserting ‘‘, except 13 that, during the 3-year period beginning on the date of 14 the enactment of the United States Virgin Islands Small 15 Business Contracting Assistance Act of 2018, such re- 16 strictions shall not apply to up to 2 mentor-protege rela- 17 tionships if such relationships are between a covered pro- 18 tege and covered mentor’’ after ‘‘each participant’’. 19 Æ VerDate Sep 11 2014 01:09 Jun 02, 2018 Jkt 079200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H5929.IH H5929 pamtmann on DSKBFK8HB2PROD with BILLS
