GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES PUBLIC SERVICES COMMISSION Docket No. 633 Order No. 53/2014 IN RE APPLICATION OF VIRGIN ISLANDS WASTE ) MANAGEMENT AUTHORITY FOR EMERGENCY ) RELIEF FROM CONDITIONS IN PSC ORDER ) NO. 20/2008 FOR AN INCREASED WASTEWATER ) USER FEE ) ) ORDER WHEREAS, on January 30, 2008, the Virgin Islands Public Services Commission (“hereinafter “ PSC” or “Commission”) conditionally approved the Virgin Islands Waste Management Authority’s (hereinafter “Authority” or “WMA”) Application for Wastewater User Fee (hereinafter “WUF”) on a temporary basis and rejected the Environmental User Fee in PSC Order No. 20/2008, Docket 554; and WHEREAS, on August 4, 2014, WMA submitted to the PSC an Application for Emergency Relief from the Conditions in PSC Order No. 20/2008 for an Increased WUF; and WHEREAS, in WMA’s Application, the Authority made the following requests: 1. That the Commission grant a twelve month reprieve from the PSC’s provisions in Order No. 20/2008 to allow the Authority to respond to these requirements; and 2. That the Authority be allowed this 12 month period to address certain budgetary and financial constraints, to assess the WUF rate increase on the next property tax bill; and 3. The Commission provides such other relief as is fair, just and equitable; and WHEREAS, on August 26, 2014, the Virgin Islands Public Services Commission held a Special Meeting in both its offices on St. Thomas and St. Croix; and WHEREAS, after reviewing the Authority’s Petition, the PSC’s technical consultant made the following recommendations: 1. The PSC approve VIWMA’s request for emergency relief from the provisions in Order No. 20/2008 for a period of twelve months; and 2. That the PSC also approve the WUF for the twelve-month period requested by the Authority; and 3. The ERU should be re-evaluated no later than June 1, 2015.
