(Continued from yesterday’s Avis) 20d Member for Christiansted Town [Canegata] remarked: Mr. Chairman. I wishto say so far as I have heard from Ist Member for Christiansted Coun- try District [Stakemann] and Ist Mem- ber for Frederiksted Country District [Andersen] I am in symapthy with what they have said, and so far where lam concerned I think it would be best to have one judge for this island and if the members of the Golonial Council would al- ways stand for their rights as thev are doing today I believe we would have nothing to fear. 2nd Appointed Member [Noll] remark- ed: Mr. Chairman. I do not care to make any remarks which might be con- sidered uncomplimentary, I like to speak on friendly terms. It seems to me that no effort was made t 0 influence this Council. It is al very,well to quote the Congressional Commission report, but it must be taken into consideration that this Council has not the jurisdiction to create an appeal court. Let us go fur- ther than the Congressional Commission report, I have heard several speak about it, but I have not heard any one say that the moral of the people of this island is at a very low ebb, neither have I heard anything said ~bout doing something to remedy it, The organization which is presented to this Council will give us the highest degree of efficiency with very little cos:. It happens that I kngw the cause of the contlict, and the man who is behind it does not want a trial by jury here nor in St. Thomas. I say we should have here the courts we are having 1. the United States in the Virgin Islands, and one man says we should not. This Council has not the power to bring a judge from Porto Rico here to sit on appeal cases. What the people of this island want is to stay where we are, and I for one do not feel that such a condition should exist. Gentlemen J am not going to talk any more; we are offering you nothing but what you had before; we are offering you laws just as you would find from Mexico to South Amgrica; 1t is for you gentlemen sl. L E%2 NIN to decide, the Government has intr.duced it, and it is considered the best that could be proposed. Gentlemen are you going to accept it or are you not going to rceept it? If you are going to believe the Congressional Commission in part , you must believe it all together.. I would agree today to pass these laws as rocom- mended by the Congressional Commission if you would agree to spend eigßt thou- sand dollars yearly for a judiciary sys- tem. [ say it again the laws which are here proposed are the best we can offer to you. If this Council had the power 1 would say let us create an appeal court, but we have not the power to create a judiciary system, we cannot do it, Con- gress can. [ls it right to create a judici- ary system here w ich will cost you eight thousand dollars yearly? 4th Appointed Member (Blackwood) remarked; Mr. Chairman. [ am'in svmpathy with the words of the Ilast speaker, but when it comes to the morel of the people of these islands I wish to state that the bill is now under 2nd Dis- cussion 2nd Appointed Member Noll: We are coming to it.) Member Black- wood continuing: As far as the question of having two judges for these Islands is concerned you are better able to say. 2nd Appointed Member [Noll] remark- ed: Mr. Chairman. I appologize if I violate the Rules of Business. Ist Member for Christiansted Country District (Stakemann) remarked: Mr. Chairman. It is not possible with such a code of laws before us to confine our- selves strictly to the Rules of Business. In the meetings of the Code Commission many questions were .asked and explana- tions were given us, but since I have looked up the laws on these questions and I find different solutions to the answers made. Coming back to the question of the laws, I know not of any man who is against having American laws here, to the contrary, we wish to have them, but I do not think it right to talk about American laws and its princi- ples if we do not stand by that same principle. Is it American principle to have a man sit here in this Council and pass laws which will create an »>ffice for himself? I did rot want to bring this up, but under the arguments adduced I am compelled to do so. 2nd Appointed Member [Noll} remark- ed: Mr. Chairman. As a United States citizen I feel that I havea right to stand in this Council and express an honest opin- ion; and I also feel that the Government has the right to have some one represent them in this Colonial Counecil. Ist Member for Frederiksted Country District (Andersen) remarked: Mr. Chairman. 1 think we are again con- fusing the issues. All that can be said for or against the organization should be said. Let us keep strictly to the ordi- nance before us and try to get some un- derstanding og that. 2nd Appointed Member (Noll) concur- .red in the wo;ds spoken by the last speaker. . The Chairman remarked: Honorable Members if there is no objectionI will proeeedto call out the sections. I think there has been sufficient discussion. As regards arguments as to whether fthere should be one or two police judges no amendment has been handed, the only amendment before me is to section 13. Accordingly the Chairman proceeded to call out the sections with the follow- ing results: Sections 1 to 12 No objection. * 13 with amendment as proposed. The Chairman read the amendment and said: My first duty is to place the amendment before you for a vote us to whether it shonld be furthered. Accordingly the Chairman put the amendment to the vote. 4 members votedin favor of; 9 against. The Chaiiman remarked: The amend- ment is jost. Ist Member fer Christiansted Country District (Stakemann) left the meeting. Sections 14 to 33 no objection. 2nd Appointed Member [Noll| remark- ed: Mr. Chairman. To Section 11 an amendment was proposed by the St. Thomas Council to which I don’t sce any ohjéctian. The Chairman replying to the last speaker said, —Amendments by Govern- ment can be brought in at 3rd Discussion. ‘2nd Member for Christiansted Tcwn (Camegata) remarked: Mr. Chairman. No amendment can be broughtin to a section after it was read and adopted. ~lst Member for Frederiksted Country Distriet (Andersen) would like to know whether the Couneil is to give an opinion as to whether there should be one or two Jndges or whether Judge Noll is to bring In an amendment that there should be one judge. : . Guiana sailed from New York on Saturday last, Bth., for this island and other ports. The boat may, therefore, be looked for inJ'red- eriksted on Saturday the 15th. The burial which will take place at Fre- densfeld has been fixed for 10 a. m. today. On the sad event sincere condolences are offered his mother and other bereaved ones.
