COMMITTEE ON HOMELAND SECURITY, JUSTICE AND PUBLIC SAFETY 05/24/2024-AMENDED AND REPORTED OUT TO THE FLOOR 05/14/2024-REPORTED OUT TO THE COMMITTEE ON RULES AND JUDICIARY BILL NO. 35-0215 Thirty-Fifth Legislature of the Virgin Islands December 11, 2023 An Act amending title 23 Virgin Islands Code, chapter 5, section 455 to require the completion of a handgun training class before the renewal of a firearm license and by amending section 457, subsection (a), paragraph (3), relating to increasing the term of the firearm license from three years to five years PROPOSED BY: Senator Milton E. Potter Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 23 Virgin Islands Code, chapter 5 is amended as follows: 2 (a) In section 455(b): 3 (1) In the second sentence, after “$150.00” insert “and a certificate of completion 4 from a handgun training class obtained within one year preceding submittal of the 5 renewal application that includes the original signature of the class instructor.”; and 6 (2) by adding a subsection (f) that reads as follow 7 “(f) For purposes of this section: 8 (1) “Handgun training class” means: 9 (A) a firearms safety course offered by a law enforcement 10 agency, an institution of higher education, or firearms training school 11 2 that is open to the public and is taught by a certified firearms instructor; 1 or 2 (B) a firearms safety course or class that is offered and taught 3 by a certified firearms instructor. 4 (2) “Training certificate” means a certificate, affidavit, or other 5 document issued by the instructor, a law enforcement agency or firearms 6 training school that conducts a handgun training class that evidences an 7 applicant’s successful completion of the class requirements.” 8 (b) In section 457, subsection (a), paragraph (3), strike the first instance of “three” and 9 insert “five”. 10 BILL SUMMARY 11 This bill amends title 23 Virgin Islands Code, chapter 5, section 455 to require the 12 completion of a handgun training class before the renewal of a firearm license and section 457, 13 subsection (a), paragraph (3), increasing the term of a firearm license from three years to five 14 years. 15 BR23-0896/December 6, 2023/LMW 16
