OPCMR AMENDMENT No. 1 OF SUPPLY CONTRACT NO. S066GVIC21(AMTS) THIS AMENDMENT made as of the /th day of January , 2023 in the Territory of the Virgin Islands, by and between the Government of the Virgin Islands DEPARTMENT OF PROPERTY AND PROCUREMENT, on behalf of the GOVERNMENT OF THE VIRGIN ISLANDS (hereinafter referred to as “Government’) and Atlantic Maintenance & Trash Removal whose address is 9003 Estate Pearl Suite 3 Christiansted, VI 00820 (hereinafter referred to as “Contractor’’). Both parties witness to being duly authorized to execute this agreement and will attest accordingly when and where necessary. WITNESSETH WHEREAS, pursuant to Supply Contract No. S066GVIC21(AMTS) approved by the Commissioner of Property and Procurement on September 24, 2021, as renewed on December 07, 2022 and (which constitute and is hereinafter referred to as the ““Contract”), the Government contracted with Contractor for the trash removal services for the Government of the Virgin Islands in the St. Croix District; and WHEREAS, the Contract expires pursuant to its terms on September 30, 2023; and WHEREAS, the parties desire to amend the Supply Contract to insert solid waste tipping fees; NOW THEREFORE, for mutual and valuable consideration, the undersigned contracting parties agree to amend the Contract as follows: TERMS AND CONDITIONS 1. Addendum II- Compensation, is hereby amended to include the Solid Waste Tipping Fee Schedule. 2. This Amendment is subject to the approval of the Commissioner of Property and Procurement and to the appropriation and availability of funds. 3. Except as expressly amended in this Amendment, all terms of the Contract remain in full force and effect.
