i69 APPEAL OF TENURE DECISION Minutes of the Board of Trustees, June 27, 1982 If the President of the College recommends to the Board of Trustees that a faculty member be denied tenure, the can- didate will be informed by the president, in writing, of the negative recommendation. The faculty member has a right to appeal that decision to the Board and request an opportunity for a personal appear- ance to present his/her case, subject to the following conditions: ae The appeal to the Board must be based on the grounds that the negative recom- mendation is unjustified because (1) the institution did not follow its own stated procedures in arriving at this recommenda- tion, (2) the recommendation was arbitrary and capricious, lacking a substantial basis in fact, (3) the recommendation was related to a*violation of the faculty member's con- stitutional rights. …

i69 APPEAL OF TENURE DECISION Minutes of the Board of Trustees, June 27, 1982 If the President of the College recommends to the Board of Trustees that a faculty member be denied tenure, the can- didate will be informed by the president, in writing, of the negative recommendation. The faculty member has a right to appeal that decision to the Board and request an opportunity for a personal appear- ance to present his/her case, subject to the following conditions: ae The appeal to the Board must be based on the grounds that the negative recom- mendation is unjustified because (1) the institution did not follow its own stated procedures in arriving at this recommenda- tion, (2) the recommendation was arbitrary and capricious, lacking a substantial basis in fact, (3) the recommendation was related to a*violation of the faculty member's con- stitutional rights. Any such appeal must be supported by a written statement supporting the faculty member's contention that the negative recommendation to the Board of Trustees was in violation of one or more of the grounds for appeal (see la, above). ~ga £6) Cc. The appeal and supporting statement must be submitted to the Chairman of the Board of Trustees not later than 30 days after receipt of notice of the president's negative recom- mendation. The president should be notified of the appeal. d. The review by the Board of Trustees will normally be based on the full written record, together with the personal appearance if desired. SP?
