DeWard: The Government of the Virgin Islands (“GVI”), acting by and through its Department of Property and Procurement (“DPP”), hereby informs the St. Thomas Reformed Church (“Church”), that, effective sixty (60) days from the receipt of this notice, the ground floor of the building on Parcel Nos. 2C & 3 Crystal Gade, Queen’s Quarter, St. Thomas, U.S. Virgin Islands, as well as the area previously identified for use as a playground during the Church’s summer programs on Parcel No. 3, are no longer available for the Church’s use. Box 365 St. Thomas, VI 00804 RE: Sixty (60) Day Notice - Termination of Use of Parcel Nos. 2C & 3 Crystal Gade, Queen’s Quarter, St. Thomas, U.S. Virgin Islands. Dear Rev. DeWard: The Government of the Virgin Islands (“GVI”), acting by and through its Department of Property and Procurement (“DPP”), hereby informs the St. Thomas Reformed Church (“Church”), that, effective sixty (60) days from the receipt of this notice, the ground floor of the building on Parcel Nos. 2C & 3 Crystal Gade, Queen’s Quarter, St. Thomas, U.S. Virgin Islands, as well as the area previously identified for use as a playground during the Church’s summer programs on Parcel No. 3, are no longer available for the Church’s use. This notice is being provided pursuant to Paragraph 3 of the Stipulated Agreement in Civil No. 731/79 (“Stipulated Agreement”), which states, in pertinent part: “Said right and permission, however, shall be at the pleasure of the Government, terminable at any time with not less than sixty (60) days’ written notice.” Although the Government has identified an alternate use for the property, the vacant land area in Parcel No. 3, located behind the Church, shall remain vacant and unimproved, and the Church shall retain access through Parcel No. 3 to the church structure. Additionally, the Church may perform repairs or maintenance to the Church from said vacant land area as necessary, as provided in the Stipulated Agreement. The Government requests that the Church provide written communication via email to property@dpp.vi.gov of any planned repairs and maintenance at least fifteen (15) business days prior to the commencement of said repairs and maintenance, so that the Government may provide notice to and coordinate with other users of this shared property, as necessary. In the case of an emergency, however, reasonable notice under the circumstances shall be sufficient.
