GUARANTEEING IN-STATE TUITION FOR CER- 1 TAIN RESIDENTS OF GUAM, THE COMMON- 2 WEALTH OF THE NORTHERN MARIANA IS- 3 LANDS, AMERICAN SAMOA, AND THE UNITED 4 STATES VIRGIN ISLANDS. 5 (a) IN-STATE TUITION RATES.—Part C of title I of 6 the Higher Education Act of 1965 (20 U.S.C. 1015 et 7 seq.) is amended by inserting after section 135 the fol- 8 lowing: 9 ‘‘SEC. 135A. IN-STATE TUITION RATES FOR CERTAIN RESI- 10 DENTS OF GUAM, THE COMMONWEALTH OF 11 THE NORTHERN MARIANA ISLANDS, AMER- 12 ICAN SAMOA, AND THE UNITED STATES VIR- 13 GIN ISLANDS. 14 ‘‘(a) IN GENERAL.—A public institution of higher 15 education that receives assistance under this Act shall not 16 charge a covered individual tuition for attendance at such 17 institution at a rate that is greater than the rate charged 18 for residents of the State in which such institution is lo- 19 cated. 20 ‘‘(b) COVERED INDIVIDUAL.—In this section, the 21 term ‘covered individual’ means an individual who— 22 ‘‘(1) is a resident of Guam, the Commonwealth 23 of the Northern Mariana Islands, American Samoa, 24 or the United States Virgin Islands; and 25 VerDate Sep 11 2014 20:27 Dec 05, 2025 Jkt 069200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6472.IH H6472 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 6472 IH ‘‘(2) is a national of the United States (as such 1 term is defined in section 101(a) of the Immigration 2 and Nationality Act (8 U.S.C. 1101(a))).’’. 3 (b) PROGRAM PARTICIPATION AGREEMENT.—Section 4 487(a) of the Higher Education Act of 1965 (20 U.S.C. 5 1094(a)) is amended by adding at the end the following: 6 ‘‘(30) The institution will comply with the re- 7 quirements of section 135A, as applicable.’’. 8 Æ VerDate Sep 11 2014 20:27 Dec 05, 2025 Jkt 069200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H6472.IH H6472 ssavage on LAPJG3WLY3PROD with BILLS
