Inc. d/b/a V.I. Recycling Company PROPOSED BY Senators Novelle E. Francis, Jr., Donna A. Frett-Gregory and Marvin A. Blyden WHEREAS, title 31, section 205(b) of the Virgin Islands Code provides that the 1 Governor of the Virgin Islands shall approve, on behalf of the Government of the Virgin 2 Islands, all conveyances, leases, or other instruments relating to the disposition of government 3 real estate; and 4 WHEREAS, title 31, section 205 (c) of the Virgin Islands Code provides that in addition 5 to the required approval of the Governor as provided for in subsection (b) of this section, no 6 sale, exchange, lease, or sublease of government real estate is binding upon the Government of 7 the Virgin Islands, unless and it is approved by the Legislature; and 8 WHEREAS, the Governor of the Virgin Islands executed a lease between the 9 Government of the Virgin Islands, acting through its Commissioner of the Department of 10 Property and Procurement, and A-9 Trucking Enterprises, Inc. and Sarnelli Bros., (V.I.) Inc. 11 d/b/a V.I. Recycling Company (“Lessee”) for the lease of an unimproved portion of Parcel No. 12 1-19 Estate Bovoni, Nos. 1 and 2 Frenchman’s Bay Quarter, St. Thomas, Virgin Islands, 13 2 consisting of approximately 247,061.17 U.S sq. ft. or 5.67 U.S. Acres of land more-or-less, as 1 more particularly shown on PWD Drawing No. A9-365-T89; and 2 WHEREAS, the premises are leased for an initial term of 10 years and are to be used for 3 the operation of a scrap metal, collections, and sales business, and for other related services. 4 These property uses are contingent on Lessee obtaining and maintaining the required permits 5 and licenses for the operation of the business; Now, Therefore, 6 Be it enacted by the Legislature of the Virgin Islands: 7 SECTION 1. Pursuant to title 31, section 205(c) of the Virgin Islands Code, the 8 Legislature approves the Lease Agreement between the Government of the Virgin Islands, 9 acting through its Commissioner of the Department of Property and Procurement, and A-9 10 Trucking Enterprises, Inc. and Sarnelli Bros., (V.I.) Inc. d/b/a V.I. Recycling Company 11 (“Lessee”), for the lease of an unimproved portion of Parcel No. 1-19 Estate Bovoni, Nos. 1 12 and 2 Frenchman’s Bay Quarter, St. Thomas, Virgin Islands, consisting of approximately 13 247,061.17 U.S sq. ft. or 5.67 U.S. Acres of land more-or-less, as more particularly shown on 14 PWD Drawing No. A9-365-T89, for the operation of a scrap metal, collections, and sales 15 business, and for other related services. The property uses are contingent on Lessee obtaining 16 and maintaining the required permits and licenses for the operation of the business. 17 Bill Summary 18 This bill approves the Lease Agreement between the Government and A-9 Trucking 19 Enterprises, Inc. and Sarnelli Bros., (V.I.) Inc. d/b/a V.I. Recycling Company(“Lessee”) for the 20 lease of an unimproved portion of Parcel No. 1-19 Estate Bovoni, Nos. 1 and 2 Frenchman’s 21 Bay Quarter, St. Thomas, Virgin Islands for the operation of a scrap metal, collections, and 22 sales business, and for other related services with these property uses being contingent on 23 Lessee obtaining and maintaining the required permits and licenses for the operation of the 24 business. 25 BR23-0318/February 1, 2023/GC 26
