Title 18 Virgin Islands Code is amended as follows: 2 (a) chapter 1, section 4: 3 (1) subsection (a) is amended in the seventh sentence by striking “shall be 4 entitled to” and inserting “may” by striking “an adverse ruling of” and inserting “their 5 removal” and by striking “the Board”; 6 (2) subsection (b) is amended in the introductory phrase by striking “boards of 7 elections” and inserting “Board”; 8 (3) subsection (b), paragraph (2) is amended by striking “boards of elections” 9 and inserting “Board”; and 10 (4) By adding the following subsection (c): 11 2 “(c) Notwithstanding the power …

Title 18 Virgin Islands Code is amended as follows: 2 (a) chapter 1, section 4: 3 (1) subsection (a) is amended in the seventh sentence by striking “shall be 4 entitled to” and inserting “may” by striking “an adverse ruling of” and inserting “their 5 removal” and by striking “the Board”; 6 (2) subsection (b) is amended in the introductory phrase by striking “boards of 7 elections” and inserting “Board”; 8 (3) subsection (b), paragraph (2) is amended by striking “boards of elections” 9 and inserting “Board”; and 10 (4) By adding the following subsection (c): 11 2 “(c) Notwithstanding the powers granted to the Supervisor of Elections 1 under subsection (b), the Board may overrule any decision of the Supervisor of 2 Elections at an official meeting of the Board.” 3 (b) chapter 3, section 41, subsection (h) is amended in first sentence by striking “each 4 Board shall be” and inserting “the Board is” and in the second sentence by striking “a” where 5 it appears before “Board” and inserting “the”. 6 BILL SUMMARY 7 This bill amends title 18 Virgin Islands Code, section 4 to clarify that the Supervisor of 8 Elections and the Deputy Supervisors of election may appeal their removal to the Superior 9 Court of the Virgin Islands, that there is a singular Board of Elections and not two district Board 10 of Elections and gives the Board of Elections explicit authority to overrule decisions of the 11 Supervisor of Elections. Finally, it also amends section 41 to clarify that there is a singular 12 Board of Elections. 13 BR25-0546/March 20, 2025/SLR 14 15
