My client has contacted Mrs. Harvey concerning access and this office has provided her counsel with a copy of the pi.ar, and a proposed accesc agreement.. To date, however, we have nor received approval, nor a request tor changes to the agreement 01 the Work Plan. In addition, information and the agreement of Mrs Harvey is needed to apply for the necessary Earth Change Permit . …

Although my client has made a.i necessary preparations and stands ready, willing and able to proceed with the remediation of a potential continuing source of contamination of groundwater in Tu^u, we are unable to proceed without Mrs. Harvey's agreement for access Regretfully, the activity scheduled for August 15, 1994, must be canceled. Any assistance which might be available in obtaining access in order that this activity might be scheduled in "he future would be appreciated.
