P 8 ® ® rovisional Ordinance. is B - WHER©ZAS, Under and by virtue of Section 4 of the Colonial Law (No. 124) published at Amalienborg, April 6, 1816, it is provided among other things as ol- lows: “In extraordinary circaims®ances the (overnor has authority to issue Pro- visional Laws or Ordinances.”’ AND. WHEREAS, by Section 2 oi an Act of Congress entitled “‘An Act to pro- vide a temporary Government for ine West Indian Islands acquired by the Uni:ed Statrs from Denmark’’, etc.. ap- proved by the President on the 3rd day of March, 1917, it is further provided in said Act as follows: “That; until Congress shall otherwise provide, in so far as compatible w.ih the changed sovereignty and not in conflict with the provisions oft is Act, the laws regulating electicas and the electoral franchise as et forth in the code of laws publiskod at Amalienborg the 6th of Apiil, 1906, and the other local laws in foree and effect in said Islands on the 17th day of Januaary, 1917, shall re- main in force and effect in said ls- lands”’ AND, WHEREAS, the rate of ex- change for an American dollar into francs of the currency of the said 's- lands has, on Oetober 15, 1919, sudden- ly advanced from $1.04 te $1.27-1/2. NOW, THEREFORE, 1, J. W. Oman, Governor of the Virgin Islands of tne United States, formerly known as (e Danish West Indian Islands, under and by virtue of :he aforesaid| ws, consid- ering extraordinary circumstances as now existing, in view of the increase in prices of necessities of life, incidenc o the aforementioned advance in the roe of exchange, hereby determine and by this proclamation do annaunce that it s essential, in order to provide suficie .t means whereby the employees of tae Government of the said Virgin Islan‘s of the Urited States may obtain sufliciet necessities of life under the salaries ncw paid to such employes in the currency of the said Is'ands, and in order thut the public good will be promoted thereby, to add to the salaries of said employe:, do hereby authorize and direct, effective immediately and until otherwise provid- ed, tha! there shall be added to the sala ry of each empleye of this Government sueh further amounts, in local currency. in addition to such salaries as will equol the difference between the normal ra e of exchange ($1.04) and the rate of ex- change existing when such salaries are due and payable. 'he Governor of the Virgin Islands is hereby authorized and empowered 0 appoint a Conmmission to fix and | reculate the selling prices for rii- | cles of food sold 1n St. roix, and ‘o | carry out the powers and duties | hereinafter set forth. 2. The said Jommission shall be known | as the ‘‘Food Commission of St. | Croix’’. The members of which | hali ko bsor Bt Cron. The | Governor shall name the Chairman of ‘ the Commission. The members of | the Food Commission shall be ap- | pointed for a period of one year and l <hall continue in office thereatter | until their successors are appoinied [ and qualified. - | 3. The Food Commission shall have | ‘ powar to investigate the prices at | whirh ali articles of food are sold or purchased by importers, merchants, | dealers, vproducers, manufacturers, or consumers, and for that purpose the books of all such shall be open to | inspection by the Food Com:uission, l and, if necessary, it may issie sub- | poenas for the attendance of wit- nesses or for the production ¢f books ! or other documents, and it shall have | the power to take testimony under oath. 4. It shall .have the power io determine the prices and quantities at which all or ary article of. food may be sold by wholesalers, retaiiers, produe- ers or manufacturers, vrovided however, a reasonable margin of profit shall be allowed. 1t shali also have the power to restrict the exportation of ali locally produced or manufac urec articies of gfood. ‘Lo the extent of the amount required for loc .l consumption; provided. the prices fixed for local sale of a locally produced or manufactured article of food shall not be less, than the ne. cash amount which might ue gained bv exportation. 5. 1t shall have the power to test all weights, scales and measures and o fix standards thereof. 6. It stall kave the pover t« make all rules and regulations necessary o efficiently carry out the yowers here- in grantel. 7. Any verscn who shall refuse to appear before the Food Commission, when summoned, or who shall refuse 1o 'tes- tify, or shall testify falsely, or shal tail t - produee books or documents re quired or shall sell any article ot food in a larger quarlity or at a higher price than preseribed by the Food “ommission, or shall use a weight, measure or scale vrohibited by the Food Commission, or shall wviolate any rule or regulation promulgated by the Food Commission, shall be guilty of a misdemeanour and on con- viction thereof shali be punished by fine of not to exceeed Franes 1,000:00 or by imprisonment rot to exceed six monihs or by both such fine and im- priscament lv the discretion of the Court. ; 3.
