GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE: ) ) Docket No. 681 ONVOY, LLC PETITION FOR AUTHORIZATION ) Order No. 2/2021 TO OPERATE AS A TELECOMMUNICATIONS ) SERVICE PROVIDER IN THE U.S. VIRGIN ISLANDS ) ______________________________________________________) ORDER WHEREAS, on August 20, 2020, the Virgin Islands Public Services Commission (hereinafter “Commission” or “PSC”) received a Petition from Onvoy, LLC (hereinafter “Onvoy”) requesting authorization to provide telecommunications services in the United States Virgin Islands (hereinafter “USVI”); and WHEREAS, on November 4, 2020, the Commission received a Report and Recommendations from its Technical Consultant, Georgetown Consulting Group, Inc. (hereinafter “GCG”); and WHEREAS, on November 9, 2020, the Commission met in regular session at its office on St. Thomas, USVI located at No. 1003 Estate Ross, Suite 4 and via its Zoom videoconference link; and WHEREAS, after review and deliberation, the Commission voted to GRANT Onvoy authorization to operate as a telecommunications service provider, subject to the recommendations included in the GCG report and to ACCEPT GCG’s Report and Recommendations; and NOW THEREFORE, the Commission finds and ORDERS that, Onvoy’s Petition for Authorization to Operate as a Telecommunications Service Provider in the USVI is GRANTED on the following findings, terms, and conditions: 1. Onvoy must offer its services throughout the USVI; 2. If Onvoy offers retail telephone service directly to end user customers including emergency responders, public safety agencies, businesses, or government agencies, it must offer those services on a common carrier basis throughout the USVI when technically feasible; PSC Order No. 2/2021 Docket 681: Onvoy, LLC Petition to Operate as a Telecommunications Service Provider in the U.S. Virgin Islands 3. If Onvoy offers retail telephone service directly to end user customers, it must file a copy of its prices, terms, and conditions with the PSC before retail service commences and must make this information available to consumers on its website; 4. Onvoy must cooperate with Government agencies and other service providers in the deployment of E911 if it is deployed in the Territory; 5. Onvoy must provide status updates, within 30 days of occurrence, to the USVI PSC on the court cases Inteliquent v. Free Conferencing, et al. and CCT Communications, Inc. v. Zone Telecom, Inc. (now ANPI Business, LLC) when the either of the following two events occurs: (1) parties reach a settlement; and (2) the court issues a final decision. So Ordered.
