GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission Inre Advance Power, LLC Application for Qualified Facility Designation Docket No. 630 Order No. 18/2018 Nee eee ee ee” ORDER WHEREAS, on June 27, 2014, Advance Power LLC (hereinafter “Advance Power”) filed an Application for Qualified Facility (hereinafier “Application”) with the Virgin Islands Public Services (hereinafter “Commission” or “PSC”) establishing Docket 630; and WHEREAS, on August 22, 2014, the Commission received a report ftom its Technical Consultants, Georgetown Consulting Group, Inc. (hereinafter “GCG”); and WHEREAS, on August 26, 2014, the Commission held a Special Meeting in both of its offices on St. Thomas and St. Croix, United States Virgin Islands; and WHEREAS, the Commission received testimony from GCG and representatives of Advance Power; and WHEREAS, after review and deliberation, the Commission approved Advance Power’s application for certification as a Qualifying Facility at Bovoni Point, St. Thomas, United States Virgin Islands (Order 56/2014); and WHEREAS, on October 27, 2015, the Commission held a Special Meeting in both its offices on St. Thomas and St. Croix, United States Virgin Islands and granted Advance Power an extension for one (1) year (Order 9/2016); and WHEREAS, on March 10, 2016, Advance Power filed a status update with the Commission; and WHEREAS, on November 2, 2016, Advance Power filed its third quarter update with the Commission; and WHEREAS, on November 3, 2016, the Commission held a Special Meeting in both its offices on St. Thomas and St. Croix, United States Virgin Islands and granted Advance Power an extension for one (1) year (Order 2/2017); and WHEREAS, on November 13, 2017, Advance Power filed a Request for Extension of Qualified Facility Certification. In that filing, Advance Power represented that progress has been PSC Docket 630 Order No. 18/2018 — QF Certification of Advance Power, LLC made on WAPA’s April 2017 Request for Proposals, and that as of October 16, 2017, WAPA notified Advance Power that its proposal was accepted and that negotiation of a power purchase agreement was pending; and WHEREAS, on December 19, 2017, the Commission held a Regular Meeting in the conference room at the Henry E. Rohlsen Airport on St. Croix, United States Virgin Islands, where the Advance Power testified on the status of their operations and requested a six (6) month extension on their status as a Qualifying Facility; and WHEREAS, the Commission voted to grant Advance Power a six (6) month extension on their status as a Qualifying Facility, with progress reports to be filed at least quarterly (every three months). NOW THEREFORE, the Commission ORDERS that: 1. Advance Power, LLC’s status as a Qualifying Facility is extended for six (6) months, with progress reports to be filed at least quarterly (every three months). So Ordered.
