Francis, Jr., by Request of the Governor WHEREAS, on February 2, 2024, the Commissioner of the Department of Planning and 1 Natural Resources issued Minor Coastal Zone Permit No. CZMIW0001-23 to Coakley 2 Plantation, LLLP for a term of 20 years; 3 WHEREAS, Minor Coastal Zone Permit No. CZMIW0001-23 allows for the 4 installation and the submerged lands occupancy of two 224’ long and 3” OD HDPE pipes in 5 approximately 6’-7’ of water to be used as an intake and brine discharge for a reverse osmosis 6 plant. The pipes are to be installed seaward of Plot 14 Estate Coakley Bay, Christiansted, St. 7 Croix; 8 WHEREAS, on April 2, 2024, the Governor of the Virgin Islands approved Minor 9 Coastal Zone Permit No. CZMIW0001-23; and 10 WHEREAS, title 12, Virgin Islands Code, chapter 21, section 911(e) provides that the 11 Governor’s approval of any coastal zone permit, or lease must be ratified by the Legislature of 12 the Virgin Islands; Now, Therefore, 13 2 Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Pursuant to title 12 Virgin Islands Code, chapter 21, section 911(e), the 2 Legislature of the Virgin Islands ratifies the Minor Coastal Zone Permit No. CZMIW0001-23 3 issued to Coakley Plantation, LLLP by the Commissioner of the Department of Planning and 4 Natural Resources and approved by the Governor of the Virgin Islands on April 2, 2024, for 5 the installation and the submerged lands occupancy of two 224’ long and 3” OD HDPE pipes 6 in approximately 6’-7’ of water to be used as an intake and brine discharge for a reverse osmosis 7 plant. The pipes are to be installed seaward of Plot 14 Estate Coakley Bay, Christiansted, St. 8 Croix, V.I., with the following special conditions: 9 (a) No other work other than the scope is allowed; 10 (b) The Division of Coastal Zone Management shall be notified at least 48 hours 11 prior to the commencement of the development activity authorized; 12 (c) A Territorial Pollutant Discharge and Elimination Systems permit must be 13 obtained from the Division of Environmental Protection for the brine discharge; and 14 (d) No dredging is permitted. 15 BILL SUMMARY 16 This bill ratifies the Governor’s approval of Minor Coastal Zone Permit No. 17 CZMIW0001-23 issued to Coakley Plantation, LLLP by the Commissioner of the Department 18 of Planning and Natural Resources for the installation and the submerged lands occupancy of 19 two 224’ long and 3” OD HDPE pipes in approximately 6’-7’ of water to be used as an intake 20 and brine discharge for a reverse osmosis plant. 21 BR24-1088/November 7, 2024/GC 22 G35-061 23
