ACTNO. 7306 BILL NO. 29-0138 Twenty-Ninth Legislature Of The Virgin Islands Regular Session 2011 An Act amending title 5, chapter 67 of the Virgin Islands Code to recognize evidentiary privileges in the U.S. Virgin Islands ---0--- WHEREAS, title 5, chapter 67 of the Virgin Islands Code, Admissibility of Evidence, Uniform Rules of Evidence, was repealed and replaced with the Federal Rules of Evidence and all subsequent amendments thereto, pursuant to Act. No. 7161; and WHEREAS, Article V of the Federal Rules of Evidence provides the general rule as it applies to privileges but states that in civil actions and proceedings, with respect to an element of a claim or defense as to which state law supplies the rule of decision, the privilege of a witness, person, government, state, or political subdivision shall be determined in accordance with state law; and WHEREAS, the Virgin Islands must determine the privileges it shall recognize; Now, Therefore Be it enacted by the Legislature of the Virgin Islands: SECTION 1. …
