Based on USCINCLANT and Justice Department assessments, concurred in by the Army General Counsel, that law and order has been reestablished, redeployment of CUTF-140 is considered appropriate at this time. Three courses of action have been considered. Course of Action #1 transitions law enforcement to St. Croix police while simultaneously withdrawing DOD forces over a twenty day period (see Tab 1). Course of Action #2 also withdraws DOD forces and additionally provides a Mobile Training Team from Second U.S. Army to assist the Virgin Islands National Guard. (The MTT can be provided independent of redeployment.) Course of Action #3 is the Virgin Islands Governor's request to deploy CONUS-based National Guard to the Virgin Islands to augment the local law enforcement effort. (Deploying additional law enforcement forces when there is no law and order requirement is inappropriate. ) RECOMMENDATION - Recommend you approve forwarding of Course of Action #1 under Secretary of the Army signature to the Attorney General (see Tab 2). This recommendation is concurred in by the National Guard Bureau and the Joint Staff. SECDEF DECISION LE E20 serves Disapproved Other: provid APM a) ae Se OE SECRETARY OF THE ARMY WASHINGTON 17 October 1989 MEMORANDUM FOR THE SECRETARY OF DEFENSE SUBJECT: Redeployment of Garden Plot Forces (CJTF-140) -- ACTION MEMORANDUM CJTF-140 was established by USCINCLANT on 21 September 1989 under the provisions of Executive Order, dated 20 September 1989, providing for the restoration of law and order in the Virgin Islands. Based on USCINCLANT and Justice Department assess- ments, concurred in by the Army General Counsel, that law and order has been reestablished, redeployment of CJTF-140 is considered appropriate at this time. Three courses of action have been considered: Course of Action #1, proposed by USCINCLANT, is a phased redeployment of CJTF-140 that transitions law enforcement to St. Croix police over a twenty-day period. This action can be initiated within 48 hours after a decision by the redeployment of one Military Police battalion and a slice of support forces. Federal enforcement of local law would terminate at the end of the 20-day transition period with all remaining Federal forces returned to the United States. See enclosure. Course of Action #2 proposes the withdrawal of CJTF-140 as in Course of Action #1, with training of the Virgin Islands National Guard provided by a Mobile Training Team from Second U. S. Army and, if required, a National Guard Engineer battalion to assist in disaster relief efforts. The mobile training team can be provided independent of redeployment actions. Engineer support is addressed below. -2- Course of Action #3, recommended by the Governor of the Virgin Islands, proposes (along with requests for military engineer and combat service support) that his National Guard be augmented by a CONUS-based National Guard Military Police battalion to assist in law enforcement efforts, prior to withdrawal of Federal troops. Deploying additional law enforcement forces to the Virgin Islands by the Federal Government when there is no law and order requirement is inappropriate. In response to a request for engineer assistance from Congressman de Lugo, an on scene assessment was made on 13 October by Major General Bunker (Corps of Engineers), members of his staff, a DOD Military Support representative, and representatives from the Federal Emergency Management Agency (FEMA). The team visited St. Croix and concluded that additional DOD support is not required. Contracts are in place and working under both FEMA and Corps of Engineer supervision and additional Active or Reserve Component Engineer support would counter ongoing efforts to stimulate the local economy. Recommend that you approve the forwarding of Course of Action #1 to Department of Justice. The requirement for Federal Forces to maintain law and order no longer exists. A 20-day phase down of Federal responsibility allows appropriate transfer to civil authority. M. P. W. C. 20530 Dear Mr. Attorney General: As Executive Agent for the Secretary of Defense, and with his concurrence, I have recommended to him that we should begin withdrawing from the Virgin Islands the Armed Forces sent to restore law and order pursuant to Executive Order 12690, September 20, 1989. This recommendation is based upon the determination of the Commander-in-Chief, U.S. Atlantic Command (USCINCLANT), and your Federal law enforcement officials that law and order have been restored and that local law enforcement officials are fully capable of resuming responsibility for enforcing the law. I intend to order a phased withdrawal of the Armed Forces over a twenty-day period in accordance with a USCINCLANT plan which will permit orderly transfer of responsibility to local authorities. This plan was coordinated with members of your office. Upon the completion of the withdrawal, our authority under Executive Order 12690 will cease. I am withholding execution of the USCINCLANT plan pending your telephoned confirmation that the coordination mentioned in the preceding paragraph does represent your office's position.
