GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE: ) ) Docket No. 669 BROADBAND VI, LLC PETITION FOR ) Order No. 30/2022 ELIGIBLE TELECOMMUNICATIONS CARRIER ) DESIGNATION IN THE U.S. VIRGIN ISLANDS ) ______________________________________________________) ORDER WHEREAS, Liberty Mobile USVI, Inc. d//b/a Broadband VI, LLC (hereinafter “BBVI”) filed a request with the Virgin Islands Public Services Commission (hereinafter, “PSC” or the “Commission”) for recertification of its Universal Service Fund (hereinafter, “USF”) eligibility pursuant to section 54.314 (a) of the Federal Communications Commission (hereinafter “FCC”) rules; and WHEREAS, annual recertification of continued eligibility is required by the FCC; and WHEREAS, on September 2, 2022, the Commission conducted preliminary discussions with all parties regarding the USF recertification; and WHEREAS, on September 14, 2022, the Commission received the Report and Recommendations from its Technical Consultant, Georgetown Consulting Group (hereinafter “GCG”); and WHEREAS, on September 26, 2022, the Commission met in regular session at its office on St. Thomas, USVI located at No. 1003 Estate Ross, Suite 4 and via its Zoom videoconference link; and WHEREAS, after review and deliberation, the Commission voted to GRANT BBVI ETC recertification subject to the following recommendations included in the GCG report and ADOPT the Report and Recommendations of the Commission’s technical consultants; and NOW THEREFORE, the Commission finds and ORDERS that, BBVI is RECERTIFIED as an Eligible Telecommunications Carrier in the United States Virgin Islands on the following findings, terms and conditions: 1) BBVI must file concurrently with the USVI PSC any reports or waiver requests submitted to the FCC and USAC. PSC Order No. 30/2022 Docket 669: Broadband VI, LLC Petition for Eligible Telecommunications Carrier Designation in the U.S. Virgin Islands 2) BBVI must file a prioritized construction plan for 2023 and 2024 by December 31, 2023, and for 2025 and subsequent years by December 31 of each year. 3) BBVI must cooperate with efforts by the PSC to monitor construction or performance against agreed technical specifications as contained in its bid or mandated by the FCC in the future. 4) Each quarter starting the fourth quarter of 2022. BBVI must notify the USVI PSC in writing when and where service is first available for a community or area of the USVI. 5) BBVI must annually file with the USVI PSC no later than July 15, of each respective year the number of Lifeline subscribers as well as the number of subscribers for any other similar-purposed low-income program such as the Affordable Connectivity Program.
