Despatching Secretary (Fox) answered: 87 L RO VX A viID It was done by President Wilson before . his term expired on March 4th. 2nd Member for Christiansted Town (Canegata) remarka=d: In view of the interest this questiorn created at the time the code was before this Council and the discussion which we had jupon it, I pro- pose, if it would serve all inrerest best, that the mztter be refenred to a commit- tee. I'ne Chairman remarked: At the last meeting Member Stakemann took objec- tion to referring a bill to a committee be- fore it is fully discussed under Ist Dis- ~ cussion, I would like to give members a ' chance to express their views on this question. f 3rd. Member for Christiansted Coun- try Distriet (Robt. W. Skeoch) remarked: Mr. Chairman. Are we going to gain anything by discussing this matter? Mr. - Wilson was President when he passed upon it, and I don’t see the necessity of | discussing and voting uponjit. It is an | executive order, and therefore it is law. ‘ Despatching Secretary (Fox) in rerly ~ to the last speaker said,—The President - did not specify that there should be one ~ judge, he only removed the section . where it is stated there shall -be one ' judge fcr each municipality. Iinter- ' pret his meaning that there should be . ore judge, taking into consideration the comparatively small popslation. | Member Canegata: If the ‘Executive ~ Order declares that there shall be one ' judge, why then bring this matter be - fore this ;Council? Despatehing Secretary (Fox) an- swered: The Executive Order does not ~ provide that there shall be but one . judge. The section providing ore judge ' in the St. Croix Code has been removed, | and it is stated in the Executive Order | that ‘‘Whereas, the President of the . United States has, in the exercise of the . right reserved to him by Executive Or- der No. 2777 of December 26, 1917, pur- suant to the provisions of Section 2 of the Act approved3 March, 1917, disap- ~ proves an set aside Section five, litle ~ one of an Ordinance providing for a Compiled Code of General and Special Laws for the Virgin Islands of tho Uni- ted States ete. : Member Canecata would like to know what would happen if the Council rein- states the section? Member Andersen in reply sa’d,—Tlhe Council I understand is at liberty to re- instate the section or alter it any way it wants it. 2nd Appointed Member (Noll) remark- ed: Mr.gChairman. Section5 provides for two judges; the President has set aside Section 5; no reason is stated for his so doing. He may have set it “aside because h* considers that two judges are not necessary, he may have set it aside because he didn’t approye the tenure of office; he may have set it aside because he didn’t approve the salary. Itisin the province of the President to put in a new section, but he simply veioed the sec- » tion, and it is new left to this Counecil to put in a new section. He has taken a negative action and this Council ean act further on this matter, at least, to advise. -As I view it, it is up to this Courcil to itake this matter and consider | it angd act upon it. | Ist Member for Frederiksted Country | Distriect (Andersen, ren arked: Do I ' understand that the President has dis- | approved Section sos the (ode of Laws . and this Section introduced comes from ' the Government of the Virgin Islands? Despatching Secretary (Fox) answer- ed: The member is right in his concep- tion, f 3rd Member for Frederiksted Country ' Distriect (Nordby) would like to know i whether he is going to receive a copy of | the Code of Laws? ‘ The Chairman answered: Within the l next ten days or two weeks every mem- ber will receive a copy. 4th Member for Frederiksted Country ’ District -(Fleming) would like t¢ know ‘ whether the DPresident has declared where the judge is to take up his resi- dence? The Chairman answered; The Presi dent has simply removed the section in | the code and the Danish lLaw covering . this section comes into effect, therefore | the judge must take up his residence in ’ St. Croix. ; drd Member for Frede:iksied Country | District (Nordby) remarked; Mr. Chair- ' man. Suppose the new election come on | before we get a copy of the Code of | Laws, will we who are going out be en- | titled to a copy just the same? | The Chairman answereu: I will see | that every member rece ves a copy. { 2nd Member for Christiansted Town | (Canegata) remarked: M. Chairman. | Inasmuch as this is an ordinance intro- . duced and subject to action as any other . ordinance, mouey bill or resolution, I ' repeat my motion that a committee of | five members be appointed to receive and . repoyg on the ordinance now before us. It was put o the vote and carried. | The Chairman gave a recess of 5 min- | utes. i ; After recess the Council reassembled ; and the Chairman asked Members to | prepare their voting tickets fora com- .~ mittee of five members to report on the Bl 1 11 voting tickets were handed in. | Elected were: Ist Member for Chris- ' tiansted Country District (Stakemann) ~and 2ndi Member for Frederiksted town ~ (Merwin) with 9 votes respectively, 2nd Appointed Member (Noli) and Ist Member ~ for Frederiksted Country District (An- dersen) -%vith 8 votes respectively, and - 2nd Member for Christtansted Town (Canegata) with 7 votes.
