(Unclassified - GLC) Met with Mr. Joseph Bastien, Executive Assistant to Senator Edward J. Gurney (R., Fla.), about the letter the Senator received from a constituent, Mr. William of Sarasota, Florida. asked for the Senator's opinion on several articles about Harold Philby especially one entitled "An Interview With Comrade Philby'' which according to purportedly showed that even CIA was fooled by Philby. The Senator's inquiry to the State Department on this was referred to us by State. I told Mr. Bastien that the Agency did not comment on matters of this sort but that I had talked to Mr. Jack Norpel, of the Senate Internal Security Subcommittee staff, who would be happy to provide him with the names of some recent publications on Philby that might be of interest to Mr. Bastien thought this would be very helpful and would be. responsive to communication, 2. (Unclassified - JMM) During a conversation with Representative John Moss, Chairman of the ig) ratio} r t rmati Subcommittee of House Government Operations Committea, I recalled the case several months ago in which he had complained to the Secretary of the Navy about the over-classification of an item which turned out to be of Agency origin. Itold Mr. Moss that this was a rather common problem, but arose from the fact that even though the item was from a Soviet publication, Voyennaya Mysl' (Military Thought), it was not widely distributed and since our only access to such material was through a unique and sensitive source we often had to restrict knowledge of our possession of it. I said Il was aware of Moss! concern about over-classification within the Government, and when- ever he had any problems with the Agency in this regard I hoped he would call on me. (I have known Mr. Moss socially for some years but have had no recent official contact with him.) Mr. Moss said he understood the problem and would indeed take advantage of my offer if the occasion arose. Gat car AY 30 September 1969 MEMORANDUM FOR THE RECORD SUBJECT: Meeting with Jack Matteson re Agency's Authority for Refusal to Provide Witnesses & Information in Prosecution of Green Berets 1. Jack Matteson, Professional Staff Member, House Foreign Operations and Government Information Subcommittee, called and advised he had just received a personal note from Chairman Moss asking him to check the authority for the Agency's refusal to provide witnesses and infor~ mation in the prosecution of a 'criminal trial'' involving the Green Berets. Representative Moss' appetite was apparently whetted by an item in this morning's New York Times that indicated in effect that the citation of legal authority for this action ''was not readily available." I thanked Jack for the call and told him I would try to be back in touch this afternoon, but if not, FOIABS5 then first thing tomorrow. occ jalso advised that the appropriate contact STAT in Army JAG is Colonel William Chilcoat, Director, Military Justice Division, telephone: 11-56433., 3, Mr. Matteson found the reference to the uniform military code a difficult authority to digest. In his attempt to reflect Representative Moss' views, Jack did not feel that the Manual for Courts Martial should have application to actions by the Director of Central Intelligence. It was neces- sary, therefore, to review with him the normal processes involved in requesting witnesses or information for use in a trial under the Manual for Courts Martial and, as in this case, the attendant determination by the head of an agency to authorize agency personnel, etc., to be used or not in accordance with the "rules" spelled out in the manual. He will call if he encounters difficulties with Army JAG. Mrs. Swift said that Mr. Hanley would not be in touch with either of his offices until after the recess. We are interested in talking with Repre- sentative Hanley in connection with his inquiry to the Army about the case of a former Agency contract employee. 8. | Jack Matteson, on the staff of Represen- tative John Moss! Foreign Operations and Government Information Sub- committee, called regarding press reports that the Agency had invoked "executive privilege" in connection with the Green Beret case. He said that Chairman Moss is extremely sensitive to any abuses of "executive privilege" by government agencies and will probably inquire about these allegations. This afternoon 1 called Mr. Jack Matteson, on the staff of Representative John Moss' (D., Calif.) Foreign Operations and Government Information Subcommittee, in response to Matteson's 25X1 earlier call to regarding the Green Beret case. Matteson was interested in press reports that the Agency had claimed executive privilege in connection with the military investigation in Saigon, and remarked that this was something that would be of major concern to Representative Moss (now in Sacramento). Having earlier checked with Mr. Houston, I told Matteson that in the present hearings under "Article 32'' the witnesses are under no compulsion to answer any particular question, and the matter of executive privilege was irrele- vant, I pointed out that the Military Court Martial Manual authorizes heads of agencies to invoke executive privilege where they consider it necessary, but I explained that the Agency had not invoked executive privilege in the present hearings and was fully cooperating with the military authorities in the investigation. JI added that at the present time we had no intention of invoking executive privilege. 2. Federal standards are those prescribing air pollution abatement practices and emissions levels established by the Secretary of Health, Education, and Welfare in 42 C.P.R. Part 76 and published in 31 Federal Register 7902 (June 3, 1966) as amended, 32 Federal Register 4415 (March 23, 1967), and, pursuant to sec. 76.3(b), include the standards, abatement prac- tices, and emissions levels prescribed by local agencies if they are more stringent than the Federal standards. Because the Secretary of Health, Education, and Welfare on April 4, 1969, proposed (34 Federal Register 6122) to eliminate paragraph (3) of sec. 76.4, requiring a smoke detector, recorder, or alarm, and to eliminate the phrase in sec. 76.8(b) restricting particle size to 60 microns, disregard these requirements in determining whether a facility was in compliance with Federal standards as of April 1, 1969. 3. Exemptions. "Exemptions" from abatement requirements are those granted by the Secretary of Health, Education, and Welfare pursuant to section 4(i) of Executive Order 11282 ("Control of Air Pollution Originating from Federal Installations," May 26, 1966). 4. Scope of survey. Tables I-A-1 through I-A-6 and I-B-1 through I-B-6 call for an installation-by-installation listing of all installations, whether or not reported to the Bureau of the Budget pursuant to BOB Circular A-78, with one or more facilities meeting any of the following criteria: --Facilities, including places of open burning, are of size and type subject to emissions limitations and air pollution abatement practices required by Federal standards as defined hereinabove. --Facilities on April 1, 1969, were not in compliance with Federal standards as defined hereinabove. ~-Facilities on April Ly 1969, were under exemption by action of the Secretary of Health, Education, and Welfare or exemption was being sought. --Facilities were to have been reported to the Bureau of the Budget pursuant to BOB Circular A-78 on or before July 1, 1969. In responee to a call from Mr. Matteson, House Government Information and Foreign Operations Subcommittee staff, I met with him and reviewed the committee file on a complaint received by the Chairman concerning classification of an item listed in the Technical Abstract Bulletin published by the Defense Documentation Center, Defense Supply Agency. The complainant noted in his letter that he had recently noticed a trend toward classification of translations from Russian books and publications and cited bulletin No. 69-3. Mr. Matteson requested that the complainant's name not be cited even though he had provided the complete file for my review. He furnished a copy of the Chairman's letter to the Secretary of the Navy (attached) for background information. 2. Ladvised Mr. Matteson that I was familiar in general with 25X1 - the Soviet publication dics that it was my understanding that it is publiahed in three versions which are classified by the Soviets. At the DCI staff meeting this morning Mr. Bross mentioned a Congressional letter to Mr. Laird concerning the planned DOD computer buy for the Command and Control System. 2. The memorandum wes signed by Representative Jack Brocks who is chairman of the Government Activities Subcommittee of the House Committee on Government Operations. Representative Brooks has no previous training or experience in the computer field but has selected this as his area of particdlar interest in government operations. 3. Representative Brooks makes the following points in his letter: No one office in DOD is responsible for overall control of all aspects of computer procurement--requirements, validation, coordination, otc.--in a program which will reach $00 million dollars over five years. There has been ro valid feasibility study or evaluation of the equipment now in see. Procurement sheuld be after system design and develop- ment, not before. There is ne indication that the new proposed system will be any better than the old. No satisfactory data manage- ment package has yet been designed for the old system. These management packages are now designed after the system is in-- not before, as they should be. This five-year prograrn is a "brute force’ method to achieve compatibility and to get away from "sole source" from IBM. It is an interim program while waiting for development of better hardware and systems--is it necessary?
