Following an investigation, DEP and Coastal Zone Management staff collected water samples from the affected runoff. Laboratory results confirmed that the beach area directly across from Prosperity Farm and Distillery does not meet established water quality standards and is currently unsafe for swimming or fishing. As a precaution, DPNR advises the public to avoid recreational activities at this location until further notice. Exposure to waters contaminated by sewage, stormwater runoff, or excessive sargassum can pose serious health risks due to elevated levels of bacteria and other pollutants. Members of the public are urged to avoid areas that: e Appear discolored e Emit foul odors e Contain large amounts of sargassum e Are near drainage basins, guts, or puddles DPNR will continue to monitor water quality and provide updates as necessary. Enterococci are bacteria that live in the intestinal tracts of warm-blooded animals, including humans, and therefore indicate possible contamination of surface waters by fecal waste. Whitaker WHEREAS, on March 30, 2022, the Legislature of the Virgin Islands, in its regular session adopted Bill No. 34-0216; and WHEREAS, section 2 of Bill No. 34-0216, amended title 29 Virgin Islands Code, subchapter I, section 225, paragraph (4), intending to allow for the construction of rum distilleries on agricultural lands; and WHEREAS, on April 11, 2022, the Governor of the Virgin Islands, the Honorable Albert Bryan, Jr., signed Bill No. 34-0216 into law, which then became Act No. 8569; and WHEREAS, citizens have submitted correspondence to the members of the Thirty- Fourth Legislature of the Virgin Islands demanding that government officials reverse the section 2 of Act No. 8569, which permitted rum distilleries to be constructed on agricultural lands and to revoke the permit that the Virgin Islands Department of Planning and Natural 10 11 12 13 14 15 16 a7 18 19 20 Exwent q-d Resources granted an applicant, on the basis that the distillery is proposed to be located across from family beaches and Mahogany Road, Frederiksted, St. Croix, and that citizens did not have the opportunity to express concern about the permit that because there were no public notices given or public hearings held regarding the granting of the permit, and that the Department of Planning and Natural Resources ignored environmental reports; WHEREAS, the public interest in the having input in the consideration of the granting of the permit outweigh any depravation the applicant may experience as a consequence of the repeal of section 2 of Act No. 8659; Now, Therefore, Be it enacted by the Legislature of the Virgin Islands: SECTION 1. Section 2 of Act No. 8569 is repealed. SECTION 2. Title 29 Virgin Islands Code, chapter 3, subchapter I, section 225, subsection (b), paragraph (4) is amended by adding “or rum distillation” at the end of the paragraph. SECTION 3. Section 2 is effective retroactive to April 11, 2022. We are not against local craft beverages or small businesses. Our concern is where and how these industrial uses are placed, and the impacts we already know about from existing rum and spirits production on St. Croix. We are especially concerned that: ° Agricultural land should protect food. A-1 and A-2 zones were created to preserve limited farmland. Allowing distilleries and breweries there makes it easier to shift land and infrastructure away from food production and raises costs for current and future farmers. e Distillery wastewater (vinasse) can seriously harm soil and coastal waters if it is not properly treated and contained. Our experience on St. Croix already shows how serious distillery wastewater problems can be. e Rum fungus has already damaged homes, trees, cars, and road signs on St. Croix near existing rum operations. Allowing new distillery uses in farm and residential areas risks spreading that same problem into more neighborhoods. e Commercial activities in R-1 and R-2 zones will reduce the value of our properties, causing a negative impact on buyers and sellers and potentially limit financing options. e Safeguards are coming after, not before. The bill opens new zones to these uses first, then calls for micro-distillery rules to be written later. Given what we already know, this is backwards. We therefore ask the Legislature to: 1. Reject Bill No. 36-0211 in its current form; and 2. Keep distilleries and breweries confined to appropriate industrial zones unless and until strong, transparent, enforceable protections are in place and fully resourced. Clean water, healthy soils, livable ncignborhoods, and a secure food future are more important than rushing new industrial uses into our farms and residential communities.
