DAVID LEON SMITH, Defendant. ) ) ) ) ) Case No. 3:25-cr-0053 ) ) ) ) ) ORDER THIS MATTER comes before the Court on the Report and Recommendation of the United States Magistrate Judge dated August 28, 2025, ECF No. 51, recommending that the Defendant’s plea of guilty to Count One of the Indictment, Possession with Intent to Distribute a Controlled Substance, a violation of Title 21, United States Code, Section 841(a)(1), be accepted, and the defendant be adjudged guilty.
