Francis, Jr. WHEREAS, on November 30, 2022, the Acting Governor of the Virgin Islands approved 1 the lease agreement between the Government of the Virgin Islands and the Virgin Islands 2 Telephone Corporation, d/b/a/ VIYA; 3 WHEREAS, the Virgin Islands Telephone Corporation, d/b/a/ VIYA will be leasing a 4 portion of a telecommunication tower and bunker in Building No. 1, Suite 2, Parcel No. 6 5 Recovery Hill, Company Quarter, St. Croix, Virgin Islands, consisting of a telecommunications 6 tower and a 9’ x 8’ room and bunker, zoned P, as shown on O.L.G. File No. 1368. The 7 telecommunications tower and a 9’ x 8’ room and bunker; and 8 WHEREAS, the rent will be $36,000, per annum, payable in monthly installments of 9 $3,000; and 10 2 WHEREAS, title 31 Virgin Islands Code, chapter 21, section 205, subsection (c) provides 1 that in addition to the Governor’s approval of any lease, the Legislature of the Virgin Islands 2 must approve all leases exceeding a term of one year; Now, Therefore, 3 Be it enacted by the Legislature of the Virgin Islands: 4 SECTION 1. Pursuant to title 31 Virgin Islands Code, section 205, subsection (c), the 5 Legislature of the Virgin Islands approves the lease agreement between the Government of the 6 Virgin Islands, acting through its Commissioner of the Virgin Islands Department of Property 7 and the Virgin Islands Telephone Corporation, d/b/a/ VIYA for a term of 10 years with the 8 annual rent of $36,000, for the purpose of establishing and operating wireless link connections 9 and housing associated equipment in the 9’ x 8’ bunker, and for no other purposes whatsoever. 10 BILL SUMMARY 11 This bill approves the lease agreement between the Government of the Virgin Islands and 12 the Virgin Islands Telephone Corporation, d/b/a/ VIYA. 13 BR23-0319/SLR/ February 1, 2023/Updated PFA 14
