GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE: APPLICATION OF CHOICE COMMUNICATIONS, ) Docket Nos. 589 & 664 LLC.FOR ELIGIBLE TELECOMMUNICATIONS ) Order No. 53/2020 CARRIER DESIGNATION IN THE U.S. ) VIRGIN ISLANDS ) (Docket 589) ) ) And ) ) APPLICATION OF VITELCOM CELLULAR, INC. ) D/B/A VIYA WIRELESS FOR MODIFICATION ) OF ITS DESIGNATION AS AN ELIGIBLE ) TELECOMMUNICATIONS CARRIER TO ) PARTICIPATE IN THE CONNECT USVI FUND ) (Docket 664) ) ________________________________________________) ORDER WHEREAS, on August 3, 2020, the Virgin Islands Telephone Corporation d/b/a Viya (hereinafter “VITELCO” or “Viya”) filed a combined request with the Virgin Islands Public Services Commission (hereinafter, “PSC” or the “Commission”) for recertification of Universal Service Fund (hereinafter, “USF”) eligibility pursuant to section 54.314 (a) of the Federal Communications Commission (hereinafter “FCC”) rules on behalf of Vitelcom Cellular and Choice Communications, LLC (hereinafter “Vitelcom/Choice”); and WHEREAS, on September 14, 2020, the Commission received the Report and Recommendations from its Technical Consultant, Georgetown Consulting Group (hereinafter “GCG”); and WHEREAS, on September 22, 2020, the Commission met in regular session at its office on St. Thomas, USVI located at No. 1003 Estate Ross, Suite 4 and via its Zoom videoconference link; and WHEREAS, after review and deliberation, the Commission voted to GRANT Vitelcom/ Choice USF Recertification as a ETC designation subject to the following recommendations PSC Order No. 53/2020 Dockets 589 & 664: Choice Communications & Vitelcom Cellular, Inc. Recertification of Eligible Telecommunications Carrier Status in the U.S. Virgin Islands included in the GCG report and ADOPT the Report and Recommendations of the Commission’s technical consultants; and NOW THEREFORE, the Commission finds and ORDERS that Vitelcom/ Choice RECERTIFICATION as an Eligible Telecommunications Carrier in the United States Virgin Islands is GRANTED on the following findings, terms and conditions: 1. Viya must provide a plan within 30 days after Stage 2 funds are released detailing the specific projects required to achieve 4G and 5G meeting FCC standards. This plan should include a description of how and where Viya intends to further harden, upgrade or expand its network its network and a timeline for the project. 2. Viya must provide to the PSC a copy of the annual FCC Form 477 and other annual documentation as required by Section 54.1514 of the FCC’s rules. This information should be filed with the PSC at the same time it is filed with the FCC. So Ordered.
