Francis, Jr. Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 3 Virgin Islands Code, chapter 25, subchapter 5 is amended by 2 inserting a new section 570b to reads as follows: 3 “570b Automatic increase in pay. 4 (a) Employees that have been employed with the Government of the Virgin Islands for 5 five years or more and have been employed with the same department or agency for three 6 consecutive years or more shall receive a 1% increase in pay on the anniversary of the date 7 they were first employed; provided that the employee has received a satisfactory annual rating 8 for the past three years of employment, pursuant to section 497 of subchapter III of this title. …

Francis, Jr. Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 3 Virgin Islands Code, chapter 25, subchapter 5 is amended by 2 inserting a new section 570b to reads as follows: 3 “570b Automatic increase in pay. 4 (a) Employees that have been employed with the Government of the Virgin Islands for 5 five years or more and have been employed with the same department or agency for three 6 consecutive years or more shall receive a 1% increase in pay on the anniversary of the date 7 they were first employed; provided that the employee has received a satisfactory annual rating 8 for the past three years of employment, pursuant to section 497 of subchapter III of this title. 9 Provided further, that the employee has not received an increase in pay for the past three years 10 of employment pursuant to a negotiated agreement and whose pay does not exceed $65,000 11 per annum. 12 2 (b) An employee that has received a less than satisfactory evaluation for any year 1 within the past three years may appeal to the Government Employees Service Commission and 2 the decision of the Commission shall be final. 3 (c) This section does not apply to employees of the Judiciary or Legislature and does 4 not apply to employees of independent instrumentalities. 5 (d) This section is applicable only in the absence of an executed contractual agreement. 6 BILL SUMMARY 7 This bill amends 3V.I.C. chapter 25, subchapter 5 by adding a new section 570b granting 8 automatic pay increases to certain employees of the government. 9 BR23-0277/January 27, 2023/AA 10
