(340) 776-6444 FAX (340) 779-4266 MEMORANDUM OF UNDERSTANDING BY AND BETWEEN VIRGIN ISLANDS TERRITORIAL EMERGENCY MANAGEMENT AGENCY AND DEPARTMENT OF HUMAN SERVICES This agreement is made in the Territory of the U.S. Virgin Islands, by and between the Government of Virgin islands, Department of Property and Procurement, on behalf of the Virgin Islands Territorial Emergency Management Agency (hereinafter “VITEMA”), and Department of Human Services (hereinafter “DHS’). WITNESSETH: WHEREAS, VITEMA constitutes the territorial agency of the United States Virgin Islands responsible for providing coordination of emergency management activities: and WHEREAS, DHS is responsible for operating the facility at the George Simmons Terrace at Adrian 16-A, St. John; and WHEREAS, VITEMA is requesting the use of the facilities at the George Simmons Terrace at Adrian 16-A, St. John to be used as Points of Distribution (POD) as a result of a Presidential Declared disaster or Governor's State of Emergency. NOW THEREFORE, this Memorandum of Understanding (MOU) shall become effective immediately following its execution by the signatories hereto, and shall remain in effect and shall terminate four (4) years thereafter unless terminated, with proper notice in writing, by either party before time lapse. Both organizations have agreed to work together to ensure the POD(s) will be available in the event of a Presidential Declared disaster or Governor's State of Emergency. SCOPE OF AGREEMENT e Under the terms of this MOU, VITEMA and DHS agree to the following: 1. DHS agrees to have the George Simmons Terrace, in Cruz Bay opened upon request from VITEMA. 2. VITEMA agrees to coordinate and facilitate the operation of the above facility following a Presidential Declared disaster or Governor’s State of Emergency. 3. This MOU shall become effective immediately following its execution by the signatories hereto, and shall remain in effect and shall terminate four (4) years thereafter unless terminated, with proper notice in writing, by either party before time lapse.
