Conditions of Approval HMGP Project # 4335-0014 Alexander Theater Safe Room/ Building Retrofit V.I. Territorial Emergency Management Agency The Project details are described below, along with the project review, funding detail, grant management requirements, and additional requirements for Phase I conditions of approval. I. Project Details Program approval is for the St. Croix Foundation for Community Development (SCF) for the retrofit of the Alexander Theater to FEMA Safe Room and Community Shelter standards and acquire a small adjacent property to allow for placement of sufficient back up power equipment as required by FEMA 361. The Alexander Theater, a 66-year-old, 12,000 square foot building that sits in the heart of Christiansted Town, offers the perfect location for a safe room and shelter. The Alexander Theater Community Safe Room and shelter will reduce the risk to people and prevent the loss of life by providing a safe, comfortable, and updated shelter option in an ideal location. The proposed Alexander Theater retrofit will provide a safe room/community shelter that meets FEMA design standards, and which serves a geographic area that is currently underserved as far as shelter capacity is concerned for hotel guests, local elderly residents and the local homeless population. This project will be coordinated with VI DHS and VITEMA to ensure the site is integrated into the territory’s shelter planning and operational requirements for safe rooms. Previously used as a cinema, the building was constructed in the 1950’s and is currently a brick shell with a new roof that was built in 2007(the roof was built to code at the time). The proposed project would include: • Wind and seismic mitigation analysis of the existing structure. • Retrofitting of the roof system and addition of structural components necessary to meet FEMA’s storm shelter standards (FEMA 361 and ICC 500) • Updated floorplan and construction design to maximize shelter capacity and operational requirements (to include hardening of existing interior features, security elements, as well as ADA compliance design requirements) • Purchase and installation of a sufficiently sized emergency generator, HVAC unit and other equipment necessary for the emergency operations of the facility. • New electrical and mechanical wiring throughout as required by code • Acquisition of small parcels of property directly adjacent to the building to be used for the installation of generator and other necessary equipment for safe room/shelter operation. The Phase I scope of work includes a technical feasibility study which will result in the final project design with full technical specifications, a complete scope of work, cost effectiveness analysis, and environmental reviews of the preferred mitigation alternatives. Conditions of Approval HMGP Project # 4335-0014 Alexander Theater Safe Room/ Building Retrofit V.I. Territorial Emergency Management Agency II. Project Review, Funding, and Grant Management Requirements Additional information is required to (1) finalize the proposed scope of work; (2) provide the information needed to complete an Environmental and Historic Preservation (EHP) review including a Section 106 review; (3) determine the project meets FEMA’s cost-effectiveness requirements; and (4) complete FEMA’s environmental compliance requirements. The project review process is, therefore, being divided into two components - Phase I (Architecture and Engineering (A&E) Design) and Phase II (Construction). Phase I funding in the amount of $1,647,153.00 is hereby authorized. This approval is contingent upon the fulfillment of all conditions identified by FEMA and itemized within this correspondence. Upon the timely completion of the Phase I deliverables, FEMA will consider additional funding in the amount not to exceed $10,904,709.00 for the Phase II construction portion of this project. The maximum total cost for both phases of this project is $12,551,862, representing 100% of the total project cost. Should FEMA approve funding for Phase II, the Sub-recipient will be responsible for obtaining all required Federal, State and/or local permits prior to construction. A copy of all permits must be submitted to, and maintained by, the Recipient. Failure of the Sub-recipient to obtain the required permits associated with the approved scope of work would violate a condition of this project approval. This could result in a determination that no Federal funding is eligible for the Project. Grant agreement articles of the FEMA-State Agreement govern this HMGP sub-award, which incorporates the grant management requirements set forth in the 44 C.F.R. The Sub-recipient has primary responsibility for management of the Project and accountability of funds, as set forth in 44 C.F.R Part 206, Subpart N and 44 C.F.R. Part 13. III. Phase I Conditions of Approval Approval of Phase II is contingent upon fulfillment of all of the following: 1) Phase 1 Deliverables a) The Technical deliverables shall include the below deliverables in the following sequential order. i) Finalized Project Scope of Work Description (1) Explanation on the intended design and expectations. (2) Detailed finalized scope of work (3) Detailed description how the overall mitigation project will be implemented. Identify the type of equipment that will be used. Also, explain how the selected mitigation for each structure will be implemented. (4) Detailed total project cost for the finalized scope of work. Territorial Emergency Management Agency (5) The cost estimate shall indicate when the funds will be expended and line item needs to be detailed in order to validate the actual expenditures at closeout. (6) Provide a detailed schedule including the dates and durations of all tasks with project milestones. ii) Final Benefit Cost Analysis (1) Finalized BCA Report iii) Final Engineering Design & Technical Specifications (1) Final design plans (2) Final design technical specifications 2) Other Regulatory Requirements As part of our approval, the Sub-recipient is required to adhere to all applicable Federal regulations including the following: 44 CFR: Subchapter A - General (Part 13 – Uniform administrative requirements for grants and cooperative agreements to State and local governments); Subchapter B –Insurance and Hazard Mitigation (National Flood Insurance Program); and audit requirements found at 2 CFR Part 200 Subpart F. 3) Scope of Work Changes In accordance with 44 CPR 13.30 (d), prior approval by FEMA is required for any revision to the scope, objectives or budget of the project. Any change that does not receive prior approval from FEMA would violate the conditions of this sub-grant. 4) Period of Performance The Period of Performance (POP) for HMGP-DR-4335-VI has been set as March 6, 2022. This is not the completion deadline for this project sub-grant. In accordance with Hazard Mitigation Assistance Guidance, FEMA will no longer establish activity completion timeframes for individual sub-grants. Therefore, the Recipient is responsible for reviewing the approved activities, the work schedule and providing the Sub-recipient with project milestones to ensure that all approved activities are completed by the end of the grant POP. 5) Quarterly Reporting Requirements Quarterly progress reports are required. These reports should reflect the status and completion date for the project being funded. Any problems or circumstances affecting the completion date, scope of work, project cost, or which could be expected to result in noncompliance with the approved grant conditions are to be described in these quarterly progress reports.
