Governor ACTNO. 8499 BILL NO. 34-0134 THIRTY-FOURTH LEGISLATURE OF THE VIRGIN ISLANDS Regular Session 2021 An Act ratifying the Third Renewal Agreement for Group Medical Health Insurance and the Third Renewal of Agreement for Group Dental Insurance between the Government of the Virgin Islands and Cigna Health and Life Insurance Company; the Second Renewal of Agreement for Vision Insurance and the First Renewal of Agreement for Group Life and Accidental Death and Dismemberment Insurance between the Government of the Virgin Islands Standard Insurance Company ---0)--- WHEREAS, pursuant to 3 V.LC. § 632(a), the Virgin Islands Health Insurance Board of Trustees with the approval of the Governor of the Virgin Islands and the Legislature of the Virgin Islands is responsible for establishing a health insurance plan for Government officers employees, retirees, and their dependents; WHEREAS, the Governor of the Virgin Islands has approved the health insurance contracts negotiated by the Health Insurance Board of Trustees between the Government and Cigna Health and Life Insurance Company and the Government and Standard Insurance Company, respectively; WHEREAS, as herein referenced, “Government of the Virgin Islands” or “Government” includes the Government of the Virgin Islands, through the Health Insurance Board of Trustees, the Virgin Islands Port Authority, the University of the Virgin Islands, the St. Thomas East End Medical Center, the Virgin Islands Housing Authority, Non-Profit Organizations defined as eligible by the Government, and Frederiksted Health Care, Inc.; and WHEREAS, the Government of the Virgin Islands and Cigna Health and Life Insurance Company executed, an Agreement for Group Medical Health Insurance approved by Legislature on September 28, 2018, which was for one year with an option to renew the Agreement for up to four, successive 12-month terms. The Second Renewal will expire on September 30, 2021, and the parties intend to execute the Third Renewal of the Agreement for Group Medical Health Insurance commencing on October 1, 2021, and ending on September 30, 2021; and WHEREAS, the Government and Cigna Health and Life Insurance Company executed an Agreement for Group Dental Insurance for one-year term, approved by the Legislature on September 28, 2018, with an option to renew the Agreement for up to four, successive 12- month terms. The Second Renewal Agreement will expire on September 30, 2021, and the parties intend to renew the Agreement for the third 12-month renewal term commencing on October 1, 2021 and ending September 3, 2022; and WHEREAS, the Government and Standard Insurance Company executed an Agreement for Group Vision Insurance approved by the Legislature on September 28, 2018, which provided for a 24-month term beginning on October |, 2018, and ending on September 30, 2022, and an option to renegotiate and renew the Agreement for up to three successive 12- month terms. The First Renewal Agreement term will expire on September 30, 2021, and the parties intend to renew and renegotiate the rates in the Second Renewal of the Agreement for Vision Insurance for an additional 12-month term commencing October 1, 2021 and ending September 30, 2022; and WHEREAS, the Government and Standard Insurance Company executed an Agreement for Group Life and Accidental Death and Dismemberment Insurance for a 36-month term commencing October 1, 2018, approved by the Legislature on September 28, 2018. The Agreement provided that the parties may renegotiate and renew the Agreement for up to two, additional, 12-month terms. The parties intend to renegotiate the rates and execute the First Renewal of the Agreement for Group Life and Accidental Death and Dismemberment Insurance commencing October 1, 2021, and ending September 30, 2022; and WHEREAS, pursuant to 3 V.I.C. 633(b), a contract for health insurance approved by the Governor must be submitted to the Legislature for the Legislature’s approval; Now, Therefore, Be it enacted by the Legislature of the Virgin Islands: SECTION 1. Pursuant to 3 V.I.C. § 633(b), the Legislature of the Virgin Islands ratifies and approves the agreements in this section which are attached to and made a part of this act: (1) THIRD RENEWAL OF GROUP MEDICAL HEALTH INSURANCE AGREEMENT This AGREEMENT made and entered into this 1“ day of October, 2021 by and between the Government of the Virgin Islands, through the Health Insurance Board of Trustees, (the “Government”’) the Virgin Islands Port Authority (the “Authority”), the University of the Virgin Islands (““UVI’), the St. Thomas East End Medical Center (“East End Medical”), the Virgin Islands Housing Authority (the “Housing Authority”), Non-Profit Organizations defined as eligible by the Government, and Frederiksted Health CARE, Inc. (“FHC”) (the Government, the Authority, UVI, East End Medical, the Housing Authority, Non-Profit Organizations and FHC hereinafter individually referred to as, each, “Employer Entity” and collectively referred to as the (“Employer”) and Cigna Health and Life Insurance Company (hereinafter “Cigna”). For purposes of this Third Renewal of Group Medical Health Insurance Agreement (the “Third Renewal”), a Non-Profit Organization is an entity determined by the Government to satisfy the requirements under applicable U. S. Virgin Islands law for participation under this Third Renewal. = — (2) THIRD RENEWAL OG GROUP DENTAL INSURANCE AGREEMENT This AGREEMENT made and entered into this 1“ day of October, 2021 by and between the Government of the Virgin Islands, through the Health Insurance Board of Trustees, (the “Government’) the Virgin Islands Port Authority (the “Authority”), the University of the Virgin Islands (“UVI’), the St. Thomas East Medical Center (“East End Medical”), the Virgin Islands Housing Authority (the “Housing Authority”), Non-Profit Organizations defined as eligible by the Government, and Frederiksted Health Care, Inc. (“FHC”) (the Government), the Authority, UVI, East End Medical, the Housing Authority, Non-Profit Organizations and FHC hereinafter individually referred to as, each, “Employer Entity” and collectively referred to as the (“Employer”) and Cigna Health and Life Insurance Company. (3) SECOND RENEWAL OF AGREEMENT FOR VISION INSURANCE This AGREEMENT made and entered into this 1“ day of October, 2021 by and between the Government of the Virgin Islands, through the Health Insurance Board of Trustees (the “Board”), the Virgin Islands Port Authority (the “Authority”), the University of the Virgin Islands (“UVI’”), the St. Thomas East End Medical Center Corporation (“East End Medical”) and the Frederiksted Health Care, Inc. (“FHC”),(the Board, the Authority, UVI, East End Medical, and FHC hereinafter collectively referred to as the “Employer’) and Standard Insurance Company (hereinafter “STANDARD”). (4) FIRST RENEWAL OF AGREEMENT FOR GROUP LIFE AND ACCIDENTIAL DEATH AND DISMEMBERMENT INSURANCE This AGREEMENT made and entered into this 1* day of October, 2021 by and between the Government of the Virgin Islands, through the Health Insurance Board of Trustees (the “Board”), the Virgin Islands Port Authority (the “Authority”), the University of the Virgin Islands (“UVI”), the St. Thomas East End Medical Center Corporation (“East End Medical’’) and the Frederiksted Health Care, Inc. Notwithstanding any other law, the sum of $16,300,000 is appropriated out of the Virgin Islands Insurance Guaranty Fund in the fiscal year October 1, 2021, to September 30, 2022, as a contribution to the General Fund. SRT Governor ACTNO. 8501 BILL NO. 34-0137 THIRTY-FOURTH LEGISLATURE OF THE VIRGIN ISLANDS Regular Session 2021 An Act amending Virgin Islands Code, title 22, chapter 10, section 237(a)(3) (A) and title 33, chapter 111, section 3061 relating to the balance in the Insurance Guaranty Fund to amend the currently required $30,000,000 amount which is set to increase to $50,000,000 on September 30, 2022, to $40,000,000 --.(--- Be it enacted by the Legislature of the Virgin Islands: SECTION 1. Notwithstanding Act No. 8126, title 22 Virgin Islands Code, chapter 10, section 237, subsection (a), paragraph (3), subparagraph (A) is amended by striking both occurrences of "$30,000,000" and inserting "$40,000,000". SECTION 2. Title 33 Virgin Islands Code, chapter 111, section 3061 is amended in subsections (d) and (e) by striking "$30,000,000" wherever it appears and replacing it with "$40,000,000". SECTION 3. The provision set forth in Section 2 expires on September 30, 2022.
