R. 2386 To amend the Energy Policy Act of 2005 to include American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the Virgin Islands in certain efforts to reduce diesel emissions. IN THE HOUSE OF REPRESENTATIVES MAY 13, 2009 Mr. SABLAN (for himself, Mrs. CHRISTENSEN, Ms. BORDALLO, Mr. FALEOMAVAEGA, and Mr. PIERLUISI) introduced the following bill; which was referred to the Committee on Energy and Commerce A BILL To amend the Energy Policy Act of 2005 to include Amer- ican Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the Virgin Islands in certain efforts to reduce diesel emissions. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DIESEL EMISSIONS REDUCTION. 3 (a) AMENDMENTS.—Subtitle G of title VII of the En- 4 ergy Policy Act of 2005 (42 U.S.C. 16131 et seq.) is 5 amended— 6 VerDate Nov 24 2008 01:47 May 15, 2009 Jkt 079200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2386.IH H2386 jbell on PROD1PC69 with BILLS 2 •HR 2386 IH (1) in the matter preceding clause (i) in section 1 791(3)(B), by inserting ‘‘in any State’’ after ‘‘non- 2 profit organization or institution’’; 3 (2) in section 791(9), by striking ‘‘The term 4 ‘State’ includes the District of Columbia.’’ and in- 5 serting ‘‘The term ‘State’ includes the District of 6 Columbia, American Samoa, Guam, the Common- 7 wealth of the Northern Mariana Islands, Puerto 8 Rico, and the Virgin Islands.’’; and 9 (3) in section 793(c)— 10 (A) in paragraph (2)(A), by striking ‘‘51 11 States’’ and inserting ‘‘56 States’’; 12 (B) in paragraph (2)(A), by striking ‘‘1.96 13 percent’’ and inserting ‘‘1.785 percent’’; 14 (C) in paragraph (2)(B), by striking ‘‘51 15 States’’ and inserting ‘‘56 States’’; 16 (D) in paragraph (2)(B), by amending 17 clause (ii) to read as follows: 18 ‘‘(ii) the amount of funds remaining 19 after each State described in paragraph (1) 20 receives the 1.785-percent allocation under 21 this paragraph.’’; and 22 (E) by amending paragraph (4) to read as 23 follows: 24 ‘‘(4) UNCLAIMED FUNDS.— 25 VerDate Nov 24 2008 01:47 May 15, 2009 Jkt 079200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2386.IH H2386 jbell on PROD1PC69 with BILLS 3 •HR 2386 IH ‘‘(A) IN GENERAL.—Any funds that are 1 not claimed by a State for a fiscal year under 2 this subsection shall be used to carry out sec- 3 tion 792. 4 ‘‘(B) REALLOCATION AMONG TERRI- 5 TORIES.—Notwithstanding subparagraph (A), 6 any funds that are not claimed by a grantee or 7 loan recipient listed in subparagraph (C) for a 8 fiscal year may be reallocated by the Adminis- 9 trator among the grantees and loan recipients 10 listed in subparagraph (C) that have claimed all 11 funds allocated for such fiscal year.
