No permission is needed, and none is ours to grant or withhold. good morning everybody um those of you those of you who have um been with me before know that typically i will have my camera on so that you can see me and we can have all the conversation i am having technical difficulties today with my camera so i will not be on camera unless it decides to act funny maybe there's a goblin or something and it'll come on and off so i apologize for that but i am here um and thank you as always for taking the time out of your day to join our our sessions our meetings um happy what day is it today thursday happy thursday to everybody um i this is really um as some of the other sessions have been simply an opportunity for you guys any questions that you have any information any clarity uh that you need uh this is your opportunity to ask all the questions um i will do my very best to give good answers um i will start off by saying a couple things i think you're probably all here because you already are on the newsletter list anybody that you know who's interested and who might not be on the newsletter or subscribe to the newsletter already please let them know that the newsletter exists it is the first place that information is published and released the newsletter as always can be subscribed to on our website which is ocr.vi.gov 0:00:00 um and in case you didn't see the newsletter that came out yesterday um ocr is hiring just fyi we're looking for uh cannabis compliance auditors two we have two positions um i would love to find two fantastic people to add to my already fantastic team um so if you know of anybody if you yourself are interested please go to the newsletter go to our facebook or instagram pages the link is there as well for the website where you can find the job descriptions and how to apply um so that's exciting news for us um also i think you should all know and that's probably why you're here that um um the cannabis dispensary applications are live on our website um the website again is ocr.vi.gov uh and that is where we live right now um so the dispensary applications are available the deadline is, I keep saying June, September 30th for those applications. As a reminder, before you get to your questions, if you have questions, the application fee for dispensary license applications is $10,000. That is the non-refundable portion. The total license fee is $25,000. VI Update · usvipublicrecords.com · public record, no rights asserted (CC0 1.0) 1 of 8 Office of Cannabis Regulation (OCR) · Q&A Session July 31, 2025 upon awarding of a license so in other words if you uh upon evaluation of your application if you're found not to meet whatever the the minimum is and the requirements are um you would not have to pay the extra fifteen thousand dollars only those who are awarded licenses will have to pay the total of 25 but the application fee itself is ten thousand dollars for everybody and it is non-refundable per the rules and regulations um so that is where i'd like to stop and then give you guys the opportunity as usual to ask whatever questions you'd like to ask the chat is available there for you to drop your questions if you'd like this is also being recorded and we will put the recording on our youtube channel just like the other previous recordings are on the youtube channel in case you know individuals who have questions you know a lot of the questions tend to be similar or sometimes there are questions that you might not think of that somebody else thought of so they are on the youtube channel i think that is also in the newsletter with the links so you can find us there with that said um lynn marie put in a great reminder anybody who is interested in working for the ocr even if it were to be on the board the cannabis advisory board you cannot have any ownership any interest stake at all in any cannabis license or permit um so just throwing that out there for anybody who who may have been interested in working um with the ocr um hi greg um we received 26 cultivation applications and we received applications for all three islands i don't have the breakdown today that will probably come out oh i just realized i forgot to put the the cab but there's a cab meeting next week wednesday um let me let me it's next week wednesday my days are all off sorry guys let me just double check the day yes next week wednesday the 6th um so that'll be broken down for you next week Wednesday at the cab meeting but there were 26 total applications 0:03:52 um any other questions anybody have any questions about the dispensary applications um hi dalton and i i know that i think you've sent that question before um and i haven't answered you because i'm i'm not really sure how we were going to do this so um the question is how would you recommend disclosing assets such as cash cash which is not in a bank on the island um so all applications all owners and financial interest holders are required to disclose um their assets and disclose the source of their assets um if someone you know that's fairly fairly easy using like income tax returns and bank account statements and things of that nature uh except if a person has a lot of cash that's not in the bank um and so we i i actually have a conversation with somebody um in a couple days uh to see how best we can do that um and you know if it's not clear you know the reason for that is that in a cash heavy industry um and and with all of the banking issues surrounding cannabis industry there is a concern amongst financial institutions etc to make sure that we're not um we're not being utilized as a way for people to um launder money uh and so i i will get back 0:06:21 to you dalton i know you've been asking um and i i just want to have a better answer for you than this one so i am working on that answer and i will i will get back to you uh and then we'll we can talk about that uh later let's see um ken uh lynn marie already got you breakdown of cultivation applications we can talk about that during cab next week what is the status on testing lab applications kimura um i have spoken to lots of people uh that here's here's what generally happens um and i i hope that you guys can appreciate it right there are a lot of people even even in the application and the licensing world there are a lot of people who say that they want to do a thing and then when i say okay great send me your information or show me your licenses etc uh that part tends to take a long time if it happens at all. So we have had many conversations with lab testing facilities or people who are interested in having lab testing facilities. And I can tell you that there are a few that we're just waiting on some paperwork from them. But definitely feeling optimistic that we will have somebody study in the territory shortly that I have had several conversations um so that that is looking very optimistic at this point in time that we'll have that soon um but it's dependent on 0:08:20 folks sending in their paperwork and getting their licenses up to get together um will the OCR consider relaxing the 70 rule if there are not enough cultivation licensees to obtain third-party cannabis. Ken, can you clarify a little? Are you saying that if you are a dispensary and you have a cultivation license as well, whether or not you're going to be required to purchase 70% outside or if you can provide your own cannabis to your own dispensary? Is that what you mean? I don't know. Where's Ken? If you can unmute yourself, Ken, because I can't see there's lots of stuff now is that what you meant ken sobel yes exactly okay um uh i i i think i think that it's certainly something that could be considered uh i know that we are going to try our best to manage supply and look at the numbers, etc. So that, you know, it is some math. I think OCR in general has really, once now that the application for the cultivation applications have closed, and we're sort of getting a sense of what the grow is potentially looking like here, we are certainly looking at how best to support our cultivators as well to make sure that they have what they need to be successful uh and to maximize their uh their output um but certainly if there seems to be an issue there with cultivation um i would think that 0:10:08 that would be an opportune time to to look at at how uh dispensaries can stay uh can can maintain their inventory and their and their product so um that's the best i can give you that's it's not a i guess it's not a it's not a firm yes or a firm no but it's certainly uh we're open to seeing what that looks like when when we get there when we get a little bit closer um you know it is it's already written in the rules um so you know any deviation from that requires a little bit of uh process 0:12:05 Machine transcript · UNVERIFIED. The answer is no. Um, I am working on that as well. Um, so I, I think we will have a better answer for that, uh, for you in hopefully soon, uh, maybe in a couple months, but, uh, the answer to that question right now is no. update on lab RFP progress saw the deadline was extended has anyone responded to the RFP does the OCR believe that there will be labs on each island in time for cultivation licenses to begin testing so we spoke about that just a few minutes ago about the labs yes people have responded no they haven't responded completely we don't have all of the information we do have some interested parties. And I actually am working on a process where there will be one lab for the territory and not one on each island. And as soon as we get the lab folks, whoever is going to be operating the lab together, we can announce how that is going to work. At the moment, I believe there will be just one lab in the territory, and it's going to be simple and not onerous on the licensees. But as soon as we get that finalized with the operator, the lab operator, we'll be able to give you guys the rundown on how that will work. um maxime under section one business plan immediately after subsection e environmental plan it asked for business plan summary including projected start date location operations and projected volume of production which seems to be um is that on the oh it's on the dispensary 0:13:17 out. Lynn Marie, can you share your screen real quick? Part one. Projected volume sounds like a carryover. Maxime, thanks for catching that. But where is it? Section one business plan. Were those awarded notified by mail? If so, when? No, the cultivation licenses have not been awarded as yet. The deadline was June 27th, June 30th, June 27th. They've not been awarded as yet. We are working on that in the office. 0:15:57 So we're just talking just generally speaking, and we're talking about how that is going to work. But yeah, no notifications as yet. Are there water and energy sources or plans for large-scale cultivation expansion plans in place already? Yeah, Lynn Marie got to your answer, Maja. That's up to the individual operators and licensees. That's not for OCR. We obviously suggest that all operators cultivators especially cultivators talking about water and energy sources look into that take that very seriously here in the territory um and include it in their application oh I meant planned resources put in place by the government to ensure encompassing business have and maintain adequate water and power necessary to provide services and supply in order to support it should be for the government um but it's not so um if you have a if you have a cultivation business in our territory um water and energy are water and energy are are a challenge um in the territory in general and um that is why that was included in the applications uh application requirements because uh hopefully we are 0:16:59 looking for people who understand that and know that that has to be an integral part of their business plan. Will there be uniformity as it pertains to qualifying certified testing labs that are approved by OCR? Meaning, will there be a threshold of accuracy that all labs will be required to adhere to? Yes. I mean, OCR is going to have standards and requirements, and the certified testing lab is the lab that will have um that will be the lab that can meet all of the requirements um other labs there are two there are two lab testing facilities in the law and the rules and regulations there's certified testing labs and regular testing labs um the regular testing labs If those exist, we'll potentially not be able to provide all of the testing, but the certified testing lab would be in there. 0:19:01 Certainly are standards and requirements in order to meet that certification. Hi, Ryan Kay. stated in the regs api keys will be made available as soon as we are able to to get that to you we will i did get your email um we just are not at that point just as yet but as soon as we're able to get it to you we'll we will we will we'll get back to you um thank you for the request it's not being ignored we just we're just not there just yet lynmarie got to your answer too is there a social equity program uh lynn marie already answered you can we get a quick 30 second 30 second review on the social equity program um lynn marie's quick draw mcgraw today um yes but social equity program the if you guys recall the requirements for all licenses are in the are outlined in detail in the rules and regulations by law it's a maximum of a thousand points right but really what that is it's 850 points for everybody and then there's 150 points of social equity points that are available if you meet one of the one of the criteria which is either service-disabled veteran ownership, female-owned entity, a majority ownership of those who are considered or who are members of an organized religion or faith that is recognized by the lieutenant governor's office and who use cannabis in 0:20:06 Machine transcript · UNVERIFIED. VI Update · usvipublicrecords.com · public record, no rights asserted (CC0 1.0) 3 of 8 Office of Cannabis Regulation (OCR) · Q&A Session July 31, 2025 there's in the practice of that faith um and or majority ownership by individuals adversely impacted by the criminal justice system or cannabis related activities that are now considered legal per act 8680 um so right um can you confirm that minority owners 49 percent or less in a dispensary applicant entity do not need to be usvi residents correct linmarie already got you um hi ryan you're asking again same question i think we i with limary and i just answered that are what's happening with my chat here um um lynn marie is on the money today do the dispensary applications need to be submitted by a certain time on september 30th yes so um and thank you kimura for the question because can i tell you guys that you guys were giving me some serious heartburn with the end of the cultivation applications um people waiting until the very last minute so to be clear part one you can submit at any point in time right your application is not considered complete until you have completed part one part two and paid your application fee 0:21:58 The deadline is September 30th. Let me make sure. What day of the week is that? Let's see. September 30th is a Tuesday. The deadline for dispensary applications is September 30th on a Tuesday. You must pay your application fee by 3 p.m. on that day, no later than 3 p.m. That is when government cashiers close. That means that we have to have it in before 3 p.m. 0:23:48 on Tuesday, September 30th, your payment. You can still submit your part two application up until 11.59 p.m. on September 30th if you need a little additional time, but I strongly, strongly, strongly, strongly advise you to please get your payment in before that if there are hiccups with the application and technical, all of those other things, you know, that can be worked, but your payment has to be in by the deadline, please. So thank you, Kimura, for the question. That was a good question. And, you know, build in some, just some wiggle room, please. I know some people, the last time it was like 2.56 PM and they were scrambling to get their payment in and then, you know, had technical difficulties or whatever might have happened with their payment, build yourself a little cushion, please, just in case. 0:24:21 I don't want you to miss being able to submit an application because you waited until literally the last minute. You know, technology is not always our friend. It doesn't always work the way it's supposed to or the way that it's intended to. So you have plenty of time. Um, I hope. Thanks. Arielle, how will you ensure confidentiality of asset disclosure? That is being the asset disclosure. First of all, there are not a lot of people who have access to the applications to begin with. 0:25:22 And that is managed by OCR, the access to that information. But then it is vetted and verified by a third-party company, a security firm, and a company out of the States who does this for a living and takes the security very seriously. So it's not, and the information just, again, I think I got this question quite a bit before. The information in your applications is not public information. It is not public record. It cannot be FOIAed. It cannot, the only thing that is public at the conclusion of the application process is the names of the people or companies who were awarded licenses. 0:26:27 so um you know nobody can come back and ask for you know joanne moorhead's application and see anything on those applications so um and and i know you don't know me but i do take that very seriously um and and so that's the best answer i can give you ariel um um what is your best guess to when we go live jeffrey hennings live um in terms of uh begin selling oh boy um i mean i would i would love to see i would love to see regulated dispensary doors open before December 31st, 2025. I, you know, I am hoping, crossing my fingers, shooting for that. I'm not sure if that is actually very practical given all of the things that are happening all at the same time, But I think that within the first quarter of 2026 is certainly doable. I would love to get it. I would love to get them open before the end, the last day of 2025. 0:27:12 But if not, I think we can make it in the first quarter of 2026. Any other questions? How do we register for the CAB meeting? I realized as I started this and I was talking about the newsletter, Ken Sobel, that I neglected to put the CAB meeting in the newsletter. I made time today. um so once a farmer gets his okay when will he be able to start growing i can't see happening until anything happening until six months after the first cultivator starts growing um jeffrey hennings in the applications and in the the process for the cultivators they have to provide a startup plan and they have they're required to start up uh in a particular time frame unless there's some really really strong compelling reason that they can't and not because they ran out of money or not because uh some some foreseen circumstance um so you know we're still hoping to be on track for awarding those cultivation licenses in september and we will see. So, you know, I think that there is probably a variance in who is ready and who's not ready out the gate. So hopefully there are some, some who are definitely ready and we should be able to see some plants soon. I hope it takes the six months off the table. We'll see. Once, actually we will also be doing some, some sessions with the cultivators, some one-on-one sessions with cultivators making sure that they're ready uh there's metric training and all kinds of things that they're going to be doing so we're going to have some time to sit with all of the cultivators and really get a good sense of where everybody is uh and what that really looks like for the for the wider landscape um so i will have a better answer for that for you um once those meetings and those those conversations happen in the next couple months um i can't believe it's august already but it's it's august is here uh and so um certainly within the next two months i will be able to get a better grasp of where that where we really stand on that um but i have a feeling it won't be it won't really be six months that's my that's my gut feeling um greg will transport of samples inter island to one lab require a federal exemption to grasp international waters from synchro to saint yes um um jody uh you you're right um preceding i i that was me with my corny jokes um i'm just saying i don't mean actually planting but there's more than just planting involved in getting the cultivation set up that your cultivation facility set up right um there's the actual physical plant facilities your security plan all of those things that also take time um so pardon pardon me for my that was a poor choice of words i was not suggesting necessarily that people go out and start planting before licenses are issued but um it was it was more of a a macro hopefully they're getting the facilities together etc etc um thanks jody um jeffrey there's a new federal law being proposed that would allow usps to ship state to state legally I'm operating, quite frankly, as if the federal government, I don't know. I don't know how to 0:31:55 predict anything that the federal government is doing. I don't even want to dip my toe in that pool in terms of trying to guess. There's lots of conversations happening. There's, you know, safe harbor banking is back again on the table, but this is not the first time. There's lots of stuff happening federally, and we'll cross our fingers that something happens that makes it easier down here for us. But true, but we're keeping an eye on the federal, the federal conversations, but moving ahead as if none of that's going to happen in the meantime. Are there any clean energy planning initiatives already put in place? do you have a more specific question clean energy specifically for cannabis clean energy just in general clean energy like um clean energy options in the territory what what's available um i mean there is the virgin islands energy office that's doing a lot of clean energy work and they have grants and they have all kinds of programs um i don't i don't know of any that are specific to cannabis. Angela, to confirm, cultivation needs to be fully approved and grown before product can be sold through dispensaries, except for those you mentioned that have begun. However, are there any regulations or restrictions around transporting cannabis between islands? Transporting cannabis between the islands for commercial purposes at this time is still prohibited uh the waters between st thomas st john and st croix are federal waters and we all know that there is a hurdle when it comes to the federal status of cannabis 0:34:17 so we are working on something for that as well as soon as i have a policy that is that i'm comfortable sharing with in public um you know i i understand it would be amazing if we could transport it i am going to say again on the record i've said this before i really do not recommend that people uh take i mean if you want to take the risk take the risk knowing this it is federally illegal there i can there's no protections if you put cannabis on your private vessel or your private plane, you are putting boat captains and pilots at risk for losing their licenses. It is not legal. That's all I can say at this time. I really, you know, I'm not ignorant of the fact that people do that all the time. But that is something that I hope that people are doing, taking a risk with information available, which again, I'm saying it is not legal. I do not recommend it. I hope that any boat captains or pilots on this chat or anybody that you know, they do put their license at risk if they are caught transporting cannabis between the islands in the U.S. Virgin Islands. Um, any other questions, comments? Um, you know, I, I, I hate to cut the, I hate to cut the meeting short because I did block out a whole bunch of time. Um, and inevitably what will happen is 0:36:13 Somebody will come around like at 1.30 and join the call and everybody will be gone. But I also don't want to tie up you guys' time. I know that everybody here is busy. And I don't want to tie you guys up much longer than we have to. Does owning land or business in the USVI provide any benefit beyond being a local resident? Um, Kimura, I'm not sure I understand the question, if you can either, can you clarify a little bit or unmute yourself and explain just so I can understand? oh um since it's a merit-based application does this help with your score owning land or a business you mean some other land or some other business that's not related to cannabis um i don't i don't i don't necessarily think so unless um you know your other business there is a section in the applications that talks about um the ownership experience uh level of experience and and certainly those who have either experience in the cannabis industry uh previous experience in in hospitality etc tourist tourist related businesses i think that is some language 0:38:08 that's in there that is looked at in that section of the application um owning land itself i don't necessarily think that that has any particular benefit in terms of your application scoring other than, of course, the requirement that you, majority of 0:40:02 Machine transcript · UNVERIFIED. So if that helps you qualify as a local resident, then I would say yes. But the business part, you know, if you had a, I'm trying to think of sort of, if you, I don't know why I gravitate to shoe store. If you have a shoe store, I don't know if that necessarily helps with your score much but um if you had some other some other business sort of uh tangentially related to cannabis or hospitality or tourism i think um that would certainly help um Alrighty. The part one of the application is part one of the application is the sort of the ownership identification and verification of assets, financial interest holders. and as a reminder when you go to our website you do have to log in in order to be able to complete the application if you are having trouble please contact the office so that we can help you the part of the reason for the login is so that we are able to help you without it before it was impossible to find your applications or any of the forms that you had started So that login helps us help you in the events of technical difficulties or challenges. So this is part one. You have to check all those boxes up at the top, please. And then the main part of the application, once you log in, it will populate that user information automatically. And then everything down here with a red asterisk is required. please put all of your information. You have plenty of space. There's options as well for you to attach a PDF if you need to. Your business ownership and percentages, if you have more than three, please feel free to attach a PDF at the bottom. And the operational information, those persons holding major operational responsibility, and then the financial resources, I believe, is the next thing. Please be truthful because that information is verified. You will see in the attestations of this, if you put information that is not truthful, you are running the risk of disqualifying your entire application. Please, please be truthful. um if something changes between the time that you submit this application and like you know i think there may have been an instance where somebody submitted an application and then realized that they forgot a document or they forgot something um please contact us i i just want to make sure that everybody is aware, because it is in the attestations. Can you go up just a little bit? um these signatures it's that where it says full legal name prints you type your name there your social security number signature just type your name again it says that this the typed name there uh does count as a signature please make sure that uh you're not signing or typing names for people who are not aware that they're being included on this application. That was an interesting phone call that I had. Anyway, please make sure this is legal. This is a legal document. This is legally binding, and those are legal signatures. So then you submit part one. 0:44:21 You fill out part one. After you submit, if you get through part of it and you need to go back and come back later to do something. You can save and resume later using the same login information. Once you submit part one, you will get a five-digit number, assigned number. You go use that number for part two. You'll see there's a space up at the top, assigned application number. It is a five-digit number. I believe it should start with a one, usually like a one zero. I don't know if we're one one yet but there's a five digit number please use that here so that we correlate your part one and part two accurately um and this is where you put in all your business plan information you can use each of those boxes individually you can put your entire part a here please provide a brief summary you can type it all in that box if you want to or you can create one document and attach it as a pdf or you can split up each section and make a separate pdf you can attach photos if you need to you can attach whatever additional documents you have obviously again this is a merit-based application so um you know there are certainly those who are trying to put their best foot forward and i urge you to take advantage of of the space that you have the ability to upload additional documents uh if you need to as well so that fill out that whole section i will make sure that that part is fixed maxime thank you for catching that and then um all the way to the bottom all of the sections correspond to exactly what is in the rules and regulations under dispensary license applications um if you have questions um people did it for the cultivation applications we try i know sometimes we might not get back to you immediately the deadline is september 30th you have time if you have questions before you submit this you can send 0:45:25 ocr an email asking for clarification asking for you know if you don't understand something asking whatever it is that you need to ask um you have time between now and then to get those questions in and get clarification that you need before you submit um once you submit it's quite different if you then decide that you have questions or you need to add things but please please please take the time to go through it now ask your questions um if you have questions this yep i think that's it i mean it's pretty much um those of you who submitted cultivation applications it's pretty similar slightly different 0:47:39 Machine transcript · UNVERIFIED. It will not be evaluated. So again, please, after the first cultivation license, I'm telling you guys, I was super stressed out that day on the deadline when everybody started calling at like 245. And then we're like, oh, how do I pay? You can go into the offices of DLCA on St. Croix or St. Thomas. You don't have to do it. Even if you're applying for a St. Thomas dispensary license, you can pay in the St. Croix office if you happen to be in St. Croix. It doesn't matter where you pay. You just need to pay in the DLCA office on either St. Thomas or St. Croix. In St. Croix, DLCA office is in Golden Rock Shopping Center, which is where the Pueblo is. It's on the end near Domino's. The DLCA cashier is open from 8.30 a.m. to 3 p.m. Monday through Friday, or every day that the government offices are open, that is when the cashier is available. Please remember 3 p.m. is the cutoff every day. and in st thomas the dlca office is located in subace in the property and procurement the three story yellow building next to the tennis courts in subace um we are on the second floor in the dlca office same hours 8 30 a.m to 3 p.m every day monday through friday that the government offices are open please please please don't forget please don't submit all of the parts of the application, and then forget to pay your fee before the deadline.
