ACT NO. 6795 BILL NO. 26-0034 TWENTY-SIXTH LEGISLATURE OF THE VIRGIN ISLANDS Regular Session 2005 To amend title 20 Virgin Islands Code, chapters 3, 5 and 43 to enact The Distracted Driving Act of 2005 and for other purposes ---0--- BE IT ENACTED by the Legislature of the Virgin Islands: SECTION 1. This Act shall be known as and may be cited as “The Distracted Driving Act of 2005”. SECTION 2. Title 20 Virgin Islands Code, chapter 43 is amended by adding section 509 to read: “§ 509 Use of handheld mobile telephones while driving prohibited (a) Definitions. As used in this section, the following words and phrases have the meanings given to them in this subsection. (1) “Engage in a call” means talking into or listening on a hand-held mobile telephone, but does not include holding a mobile telephone to activate, deactivate or initiate a function of such telephone. (2) “Handheld mobile telephone” means a mobile telephone other than a hands-free mobile telephone with which a user engages in a call using at least one hand. …
