THIS MATTER is before the court on Appellant’s motion for costs dated August 14, 2007. This Court affirmed the judgment of the Superior Court in this matter by Memorandum Opinion dated October 18, 2007. The Virgin Islands Supreme Court Rules provide that “if a judgment is affirmed, reasonable costs shall be taxed against the appellant...” V.1S.CT. R. 30(a) S. Ct. Civ. No. 2007-25 Van Lingen v. Davila Order (emphasis added). Appellant is not a prevailing party in this matter and, therefore, is not entitled to an award for costs. Accordingly, it is hereby ORDERED that Appellant’s motion for costs is DENIED. Dated this 29th day of October, 2007.
