COMMITTEE ON GOVERNMENT OPERATIONS, VETERANS AFFAIRS AND CONSUMER PROTECTION BILL NO. 36-0061 Thirty-Sixth Legislature of the Virgin Islands March 28, 2025 An Act amending title 3 Virgin Islands Code, chapter 27, section 706 and chapter 28A, section 755 allowing retirees who are receiving an annuity from the Government Employees Retirement System who are subsequently employed by the University of the Virgin Islands (“UVI”), to continue to receive their GERS annuity while receiving their salary from the University if the retiree enrolls in a different retirement plan PROPOSED BY: Carla J. Joseph Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 3 Virgin Islands Code is amended in the following instances: 2 (a) In chapter 27, section 706, add subsection (g) to read as follows: 3 “(g) A retiree who re-enters the service of the government to be employed by the 4 University of the Virgin Islands, may continue to receive an annuity while in receipt of a 5 salary from the University of the Virgin Islands if the retiree is enrolled in an alternative 6 retirement system.” 7 (b) In chapter 28A, section 755, add subsection (f) to read as follows: 8 “(f) A retiree who re-enters the service of the government to be employed by the 9 University of the Virgin Islands, may continue to receive an annuity while in receipt of 10 2 salary from the University of the Virgin Islands if the retiree is enrolled in an alternative 1 retirement system.” 2 BILL SUMMARY 3 This bill amends title 3 Virgin Islands Code, chapter 27, section 706 and chapter 28A, 4 section 755 to allow for Tier I and Tier II retirees who re-enter the service of the government 5 to be employed by the University of the Virgin Islands to continue to receive their annuity while 6 receiving their salary from the University of the Virgin Islands if the retiree is enrolled in an 7 alternative retirement system. 8 BR25-0359/February 3, 2025/GC 9
