Thomas Lee Stephens Citation: 979 F.2d 1537 (11 th Cir. 1992) Capsule Summary of the Case: Thomas Stephens, having previously been convicted of two prior drug offenses, was convicted by a jury of possession with the intent to distribute more than 50 grams of "crack" cocaine. State officers received a tip from a hotel clerk that Stephens, a wanted person, was staying at a certain hotel. During a consent search of Stephens room, officers found a large quantity of cocaine base, commonly referred to as "crack" cocaine. He was sentenced to life imprisonment as a habitual offender. Torres- Labron Citation: 979 F.2d 1537 (11th Cir. 1992) Capsule Summary of the Case: Urbano Torres-Labron was convicted by a jury of possession of a weapon by an inmate. While an inmate of the Bureau of Prisons, Torres-Labron attacked a fellow inmate with a "shank"-- a single edge razor blade which had been embedded in a wooden handle. Jose Velasco Citation: 12 F.3d 217 (11 th Cir. 1993) Capsule Summary of the Case: Jose Velasco was convicted by a jury of conspiracy to possess with the intent to distribute more than 5 kilograms of cocaine. Members of the Drug Enforcement Agency used a confidential informant to make several purchases of cocaine from Velasco. The Agents made audio and video recordings of the purchases. Evidence adduced at trial showed that Phillips had exclusive control of all the postage stamps assigned to the Gainesville post office. Alphonse Gainer Citation: 65 F.3d 181 ( 11 th Cir.1995) Capsule Summary of the Case: Gainer was convicted by a jury of possession with the intent to distribute more than 50 grams of "crack" cocaine. Evidence adduced at trial showed that Gainer and several co-defendants were residents of south Florida. They traveled to the Northern District of Florida(NDFL) for the purpose of selling "crack" cocaine because they had been told by an acquaintance that they could sell "crack" cocaine at a higher price in the NDFL. Officers received a tip from a confidential source that Gainer was utilizing several women from a local public housing community to distribute his "crack"cocaine. Agents solicited and received the cooperation of several of the women to assist in purchasing cocaine from Gainer. Gainer was sentenced to forty years in the Bureau of Prisons as a "habitual offender." District Judge Lacy Collier, Northern District of Florida, presiding. Cory Fluellen Citation: 265 F.3d 1063 (11 th Cir. 2001) Capsule Summary of the Case: Mr. Fluellen was convicted by a jury for conspiracy to possess with the intent to distribute more than 50 grams of "crack" cocaine. Fluellen and his co-conspirators traveled to the Panama City, Florida, area to sell ounce quantities of "crack" cocaine to street level drug dealers. Upon arrival in Panama City, Mr. Fluellen and his co-conspirators checked into a local hotel. A confidential informant notified the police that Mr. Fluellen was storing "crack" cocaine in his hotel room. Pursuant to his consent to search the hotel room, agents found approximately 300 grams of "crack" cocaine. Mr. Fluellen was sentenced to 360 months in the Bureau of Prisons. John Collier Wims Citation: 245 F.3rd 1269 (11 th Cir. 2001) Capsule Summary of the Case: Mr. Wims was convicted by a jury for conspiracy to possess with the intent to distribute cocaine and cocaine base, commonly referred to as "crack" cocaine. Evidence adduced at trial showed that Mr. Wims, a resident of Rochester, New York, would travel to Miami, Florida, in order to purchase multi kilogram quantities of powder and "crack" cocaine. The powder cocaine was later transformed to "crack"cocaine and it and the purchased "crack" cocaine were sold in Gainesville, Florida, and Rochester, New York. Mr. Wims was sentenced to life imprisonment in the Bureau of Prisons. District Judge Maurice M. Paul, Northern District of Florida, presiding. Josephine H. Rony Dan District Court Case Number: 2000-145, District Court of the Virgin Islands, {2000} Capsule Summary of the Case: A jury convicted Rony Dan of Fraud and Misuse of Visas, Permits and other Immigration Documents. Evidence adduced at trial showed that as Mr. Dan was attempting to leave St. Thomas, VI, Immigration Inspectors found a fraudulently- obtained visa, Social Security card and work permit in his wallet. Mr. Dan testified that he thought the documents were lawfully obtained because they were provided by his employer .However, during the trial it was shown that his employer did not provide the documents to Mr. Dan. He later cooperated with law enforcement officers and said that he purchased the fraudulent documents from someone who was selling them on the streets in the city of New, York. Appx. 360, 2003 WL 21469342 {3d. Cir. {Virgin Islands}} Capsule Summary of the Case: Mr. Chinnery was convicted by a jury of committing perjury during his testimony in an earlier case. In that case, Mr. Chinnery was charged with violations of federal civil rights statutes. In his capacity as Drug Policy Advisor to the Governor of the Virgin Islands, Mr. Chinnery, acting under the color ~flaw, struck a victim in the head with his service revolver. During his trial on the civil rights violations charges, he testified falsely concerning several material matters. Subsequently, he was indicted and found guilty of perjury. Pedro Adames and Magdalena Oita Dolison Citation: 59 Fed. Appx. 442, 2003 WL 283186 (3d. Cir. (Virgin Islands)) Capsule Summary of the Case: Dolison was convicted by a jury for conspiracy to possess with the intent to distribute cocaine and Adames was convicted of smuggling cocaine into the United States and conspiracy to possess with the intent to distribute cocaine. Evidence adduced at trial showed that the defendants were using cruise ship employees to smuggle cocaine from the Netherlands, St. Martin into St. Thomas, VI. Acting on a tip, agents were conducting a surveillance of a cruise ship when they observed a cruise ship employee meet with the defendants in the area of the cruise ship dock located in St. Thomas. The cruise ship employee was in possession of more than a kilogram of cocaine. The employee agreed to cooperate with the agents. After he was assigned counsel to represent him, he entered a plea of guilty and, testified as a government witness at the trial of the defendants. Describe the nature of your participation in this question, please omit any information protected by the attorney-client privilege (unless the privilege has been waived) In 1989, I was assigned as the Division Chief of the Special Assault/Domestic Violence Unit. In that capacity I was charged with the supervision of all sexual assaults, domestic violence and child abuse cases filed in the State Attorney's Office, Fourth Judicial Circuit, Jacksonville, Florida. Additionally, because 37 of the 115 homicides occurring in 1989 were a result of domestic violence, I was tasked with developing a comprehensive domestic violence protocol in order to protect the rights of the victims of domestic violence and, to assist in the investigation and prosecution of cases of domestic violence. To achieve this goal, I researched the domestic violence laws and protocols of other states in order to identify a suitable model. I found that the state of Minnesota domestic violence laws mirrored Florida's domestic violence laws and, the city of Duluth, Minnesota had what was then viewed as the best domestic violence protocol in the country. Using the Duluth protocol as a model, I developed the first protocol for victims of domestic violence used by the State Attorneys office, to assist the prosecutors in preparing and presenting their cases in court. The protocol required the involvement of "The Domestic Violence Intervention Project" which was an initiative designed by the ·"Hubbard House," the local shelter for battered women, to stop domestic violence and protect battered women. A committee composed of representatives of the Jacksonville Sheriff's office, the State Attorney's office, judiciary, probation and parole and the local counseling agency was formed to coordinate efforts in order to best serve the victims of domestic violence. I received the Mayor of Jacksonville's "Victim Rights Award," based in part, on my efforts in protecting the rights of victims of sexual assaults and domestic violence. As the Chief Prosecutor of the Clay County Division of the State Attorney's Office in Jacksonville, Florida, 30 to 40 percent of the cases filed by my office each year were committed by offenders 18 to 25 years old. This was a dramatic increase in juvenile crime from prior years. At the same time my division was experiencing an increase in juvenile and teenage crime, the state was cutting back on the number and quality of the programs offered in the state prison system, which were designed to address the needs of the teenage offender. To address this problem, with the cooperation of the defense attorneys, Clay County Sheriff's office and, the probation office, I developed a program where the sentencing court would allow teenage offenders whose sentencing guidelines recommended a sentence of less than eighteen months in state prison, to be sentenced to twelve months in the Clay County jail. The sentencing judge would order that the sentence be served in the Clay county jail on the weekends. The probation officer assigned to these cases assisted the offender in obtaining or maintaining employment or, in acquiring necessary skills to become employed. For those teenage offenders who were high school dropouts, they had to obtain a "GED" in order to remain in the program. To encourage a teenage offender to take advantage of this program, substantial time off their sentence was awarded for taking steps toward rehabilitation and good behavior. While this program required the use of weekend jail space normally reserved for adult offenders, who were serving their jail sentence on the weekend, the Sheriff of Clay County recognized the need for such a program and provided as many beds as possible to assist in this intervention effort. Also, the program received the support of the community. For this effort to prevent the habitual criminal behavior of teenagers and, the aggressive prosecution of adult habitual offenders, I was awarded the town of Orange Park, Clay County, Florida "Key to the Town of Orange Park Award."
