B) Description of Work – This project consisted of construction of concrete sidewalk along Julian Jackson Drive, permanent signing, pavement markings, timber handicap access ramp, rockery retaining wall, utility relocation, and other miscellaneous work. C) Environmental Considerations – National Environmental Policy Act (NEPA) Compliance: A Categorical Exclusion under 23 CFR Chapter 1 771.117(d) (1&3),was prepared and signed by Federal Highway Administration on August 23, 2008. SHPO – 106 Concurrence: By letter dated September 5, 2008, the Virgin Islands State Historic Preservation Office determined that there were no known cultural resources within the proposed project area protected under the requirements of Section 106 of the National Historic Preservation Act. FWS Section 7 Concurrence (endangered Species): By stamp dated June 14, 2004, the U.S. Fish and Wildlife Service and St. Thomas, U.S. Virgin Islands National Marine Fisheries Service (NMFS) concurred that there were no known adverse affects anticipated on resources protected by the Endangered Species Act of 1973. The Department of Planning and Natural Resources (DPNR) of the US Virgin Islands issued a Building and an Earth Change Permit for the project. Building Permit No. 082- 09 was issued by the Division of Permits on December 19, 2008, to the VI Government Department of Public Works (VIDPW). Earth Change Permit STT-025-09 was issued by the Division of Environmental Protection and was signed December 12, 2009, to the VIDPW. 1 II) PROJECT DATA A) Specifications – Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-03 (US Customary Units). This change was requested by the VIDPW as a safety concern. Drainage structures such as 18-inch concrete curb and gutter and catch basins were added to the contract due to the new drainage necessities that the area would have after raising the elevation of the sidewalk. Structural fill and embankment construction items were added to raise the elevation of the sidewalk as needed. Additional quantities for items such as saw cutting, 18-inch reinforced concrete pipes, concrete curbs, concrete accessibility ramps and a junction box were added to the contract to adjust the project to the new elevation of the sidewalk. After a field inspection of the area, EFL noticed that a substantial amount of the existing curb was damaged and it was in the interest of the project to replace it. Additional amounts for removal of curb and concrete curb were added to the contract in order to solve this issue. In order to safeguard public safety at Brewer’s Beach, the VIDPW requested EFL to install a rail between the riprap class 4 and the sidewalk in this area. VIDPW was concerned with pedestrians trying to cross towards the beach area through the riprap instead of the designated access points. A new item, Aluminum Bridge Railing, was created for this purpose. Net contract increase = $484,000.00 Contract time increase = 45 calendar days CM No. 0002 was a bilateral CM issued primarily to address overruns and underruns in the contract due to raising the elevation of the sidewalk. In addition, new items were incorporated into the contract in order to properly address the drainage in the project. These items included an end section for the 18-inch RCP, a manhole (including frame and cover) and hot asphalt concrete pavement. 6 Per VIDPW’s request, a pay item for treated timber stairs was created to provide adequate access to Brewer’s Beach that was overlooked in the original design. The original plan only provided one entrance to the beach across the installed riprap. In order to provide additional access points, two staircases were added at each end of the riprap. Net contract decrease = -$2.24 Contract time increase = 60 calendar days CM No. 0003 was a unilateral CM issued to stop work on the contract due to lack of available funding. (The U.S. Government was in furlough status) No change in contract amount. No change in contract time. CM No. 0004 was a unilateral CM issued to lift the stop work order issued with CM No. 003. The contractor was directed to propose a equitable settlement for costs and issues that rose due to the stop work order. No change in contract amount. No change in contract time. CM No. 0005 was a bilateral CM that created a new pay item for the repair of the St. Thomas Airport’s control tower power line. The contractor damaged the power line while he was excavating to place sidewalk. The power line had not been installed per code, thus the contractor was unaware of its existence. Underruns of the silt fence, riprap class 4 and the rockery wall were used to fund this work. Net contract decrease = -$255.15 Contract time increase = 61 calendar days CM No. 0006 was issued to adjust the quantity of existing items and to create four new Contract Modification items, for contractor remobilization, paining of beach access ramps, steel plat ramps over paved waterway, and planting of new bushes as requested by the Virgin Islands Department of Public Works. This CM also extended the contract completion date to November 26, 2010. No change in contract amount. Contract time increase = 138 calendar days CM No. 0007 adjusted the final quantities to match existing field conditions or that varied form the Original Engineer’s Estimate. Net contract decrease = -$94,054.44 No change in contract time. Significant Overruns and Underruns Item 15705-0100: Soil Erosion Control (SEC), Silt Fence underran by 9.1 percent due to adjustments made to match existing field conditions. Item 15705-1700: SEC, Filter Berm underran by 17 percent due to adjustments made to match existing field conditions. 7 Item 20101-0000: Clearing and Grubbing underran by 29.5 percent due to adjustments made as consequence of the addition of drainage structures to the project. Item 20302-0200: Removal of Curb overran by 1283.55 percent due to the need to replace existing curb that was damaged and was not addressed in the plans. Item 20303-0300: Removal of Concrete (Stair Landing) overran by 134.7 percent due to adjustments made to match existing field conditions. Item 20303-1600: Removal of Pavement, Asphalt overran by 193.6 percent in order to place curb and gutter with minimum disturbance to the road’s appearance. Item 20315-0000: Sawcutting Pavement overran by 3783.86 percent in order to place curb and gutter with minimum disturbance to the road’s appearance. Item 20401-0000: Roadway Excavation underran by 34.1 percent due to the decreased need of excavation as a result of raising the elevation of the sidewalk. Item 25210-0000: Rockery (Wall) underran by 18.9 percent due to adjustments to match existing field conditions. Item 41702-0000: Minor Cold Asphalt Mix underran 41.32 percent due to existing field conditions. Item 55201-0200: Structural Concrete, Class A(AE)(Stairs) underran 27 percent due to adjustments made to match existing field conditions. Item 60201-0600: 18-inch Pipe Culvert overran by 3666.67 percent in order to find an outlet for the drainage system as a result of raising the sidewalk 6 inches above it. Item 60801-0400: Paved Waterway, Type 4 overran by 858.4 percent due changes made to raise the elevation of the sidewalk. Item 60901-0000: Curb, Concrete, overran by 965.5 percent for two reasons. The need to replace existing curb due to its dangerous condition which was not addressed in the plans and additional curb was required to raise the elevation of the sidewalk adjacent to the paved waterway that was part of the new drainage system. Item 61501-0100: Sidewalk, Concrete, underran by 8.5 percent because of segments of the sidewalk were eliminated per the request of VIDPW. 61505-1000: Accessibility Ramp, Concrete, overran by 225 percent in order to make the sidewalk accessible for people with disabilities as a result of raising the sidewalk 6” above the roadway elevation. 8 62401-0100: Furnishing and Placing Topsoil, 2-Inch Depth, underran by 42.6 percent because the buffer area between the roadway and the sidewalk was no longer required after the curb and gutter were added to the project. Item 62501-0000: Turf Establishment underran by 43.67 percent because the buffer area between the roadway and the sidewalk was no longer required after the curb and gutter were added to the project. Item 62901-1100: Rolled Erosion Control Product, type 4, underran 61.21 percent due to adjustments to match existing field conditions. Item 63304-0900: Sign, Aluminum Panels type 3 Sheeting, overran by 19 percent to provide signage for the implementation of new accessibility measures. 2. Problems The main problem presented on the project was the sidewalk on the original plans was to be built at the same elevation as the roadway. This represented a safety issue as there was no buffer area between the roadway and the sidewalk. The VIDPW requested the sidewalk to be elevated 6 inches above the roadway. These changes created the need for construction of new concrete curb and gutter throughout the project and subsequently a need to address the storm water discharge. A new survey of the area was necessary and a new design for the drainage within the project. D) Recommendations – Plans should be reviewed in depth by the client prior to construction.
