The Chairman replied, Not now. 2nd Appointed Member [Noll] The bill has been subject to amendment pre- viously for two weeks. 4th Appointed Member [Blackwood]: Yes, but you cannot expect men who are not lawyers to pass on such a code of laws without giving.it careful consider- ation. AsI understand it you are try- ing to give us laws to suit_ conditions down here, it is said that the laws be- fore us have been selected from State laws, a great deal of them are not com- prehensive; why not pick out a leaf of Great lritain laws ? The proposal here for judges and appcal eourt is the sume as we have in the Staterof Maine, but it is quite different to what we have been accustomed to here, and therefore we should have a chance to go over them to find out how they are going to operate before we vote on them; we want laws that will give every man, woman and child fairplay. . I know of an instance where a judge once said “‘lam the law’’. If that is going to be the case when thece laws are passed, then I think it is best to listen to the advice *of those who are versed in the law. We want to study these laws, give us time and when it is passed there won’t be any trouble. [ understand this is tde second” m~eting in which second discus- sion is before the House, but at first discussion ' we had not the Congressional Commission report, consequently it is not unpatural ifa member brings in an amendment at this time. We were given to understand that it was Government’s desire that no chapges be made in the matter which is before us, and at the end of the second meeting the Congres; sional Commission’s recommendations came to hand and itis in line with what many of us have cdesired; therefore it cannot be deemed unnaiural if an amend- ment providing for two judges is pro- posed at this time. - : The Chairman replying to the last speaker said,—The ordinance was placed before you today on contin:atione of - second discussion and discussion closed and according to the the rules of busi- ness I°can only deviate from the rules by a vote of the Council; I desire to be perfectly fairin my rulings. 1 cannot see where I am wrong by closing second discussion. ’ ist Member {or Frederiksied Couutlry District (Andersen) handed in an amend- ment to . ' AMENDMENT I propose that Section 5, Chapter one be amended to read: There shall be ap- pointed by the Governor two Distriet Judges, one for the Municipality.of St. Croix and one for-the Municipality of St. Thomas aud St. John. who shall hold office etec. : . .- -F. The €hairman read the amendment and said,—lt is necessary to have a three quarter vote of the members pres- ent as to whether the amendment should be furthered; and it is also-necessary to have a three-quarter vote as to whether it should be considered today. +« 2nd Appointed Member (Noll) remark- ed: Mr. Chairman. Before you take the vote or the amendment I wish to make a few remarks. The question be- fore the House is very plain; it i 3 a ques- tion that was brought up at ‘the last +meeting; the amendments have been printed and circulated, and for what rea- son this amendment is brought up at the eleventh hour? Nothing else but for the specific purpose of delaying this Council on this matter. Gentlemen if you want two judges voteein favor of the amend- ment, if you don’t want two judges, then don’t delay the law; if you want to Americanize the community of these islands. do somethimz. .that will help Americanize theém. .Gentlemen let us be reasonable; if this amendment passes it" will cause us to spend eight thousand dollars more yearly; get away from the idea of being afraid of Lhaving a judge who is going to try a case here and in St. Thomas. We have judges in the United States going up and down almost every day trying cases exeept when heis en vacation. I7 you annex this ‘amendinent you will have to spend eight thousand dollars to maintain” yourcourts. Ist Member for Frederiksted Country District (Andersen) remtarked: Mr. Chair- man. It may be worth the whiie to spend the eight theusand do'lars, for the reason that if “we pass the law to bhave one judge, the judge probably will take up his residence in St. Thomas and we will not see him often. Is ine Federal Treasury of the United States going to pay the School Direcior’s salary, or is it to be paid by the Colonial Treas ary 7 : Despatching Seeretary [Colby] an- swered the last speaker and said, The Federal Government has =lready appro- priated thrce hundred and forty-seven thousand dollars for these islands and in that is inciuded salaries for ike De- partment of KEducation. Tnhe Federal Governnient now pays the salary of the School Director. Ist Member for Frederiksted Coun- try District (Andersen) remarked: Mr. Chairman. Some day we may not get an appropriation, what then ? The Chairman answered and said, The Governor advises me that he does not intend to make any change.
