VIRGIN ISLANDS CASINO CONTROL COMMISSION POSITION VACANCY ANNOUNCEMENT FOR INDEPENDENT HEARING OFFICER (IHO) Salary Range: $250/Hour Contract Position Location: St. Croix, U.S. Virgin Islands POSITION SUMMARY: Under the direction of the Chairman/Chief Executive Officer of the Casino Control Commission or other designated authority within the Casino Control Commission, the Independent Hearing Officer (IHO) is responsible for ensuring that entities and persons participating in every and all gaming operations, within the jurisdiction of the Commission, comply with all federal and territorial laws and Casino Control Commission’s Rules and Regulations. The IHO is appointed by the Virgin Islands Casino Control Commission (“the Commission”), pursuant to Title 32, Chapter 21, Article II, §408(d) of the Virgin Islands Code, which empowers the Commission to contract for services of professional, technical, and operational personnel and consultants as may be necessary to the performance of its responsibilities under this chapter. SCOPE OF SERVICES 1. z. The Commission hereby engages the Independent Hearing Officer to preside at hearings as assigned by the Commission, and to perform other services incidental to such assignments. The Independent Hearing Officer shall perform his or her duties in conformity with all applicable U.S. Virgin Islands and federal statutes and Commission rules, regulations, and policies, as the same may be amended from time to time, including without limitation to Casino Control and Resort Act of 1995, The Virgin Islands Internet Gaming and Internet Gambling Act, the Virgin Islands Horseracing Industry Assistance Act of 2011. The Independent Hearing Officer shall comply with the Virgin Islands Model Rules of Professional Conduct, and all applicable professional and ethical rules adopted by the Supreme Court of the Virgin Islands governing attorneys in the practice of law in the U.S. Virgin Islands. In matters assigned by the Commission, the Independent Hearing Officer shall perform the duties of a hearing officer on behalf of the Commission in administrative adjudications pursuant to the Casino Control and Resort Act of 1995; The Virgin Islands Internet Gaming And Internet Gambling Act; the Virgin Islands Horseracing Industry Assistance Act of 2011; and the rules and regulations adopted by the Commission, which unless explicitly directed otherwise in writing by the Commission, for each such matter, shall include without limitation case management and scheduling; hearing and ruling in pre-hearing motions; appearances at the hearing location specified by the Chairman of the Commission; conduct of the evidentiary hearings; marshaling of the hearing record; and preparation of a hearing officer report. QUALIFICATIONS: EDUCATION AND EXPERIENCE MINIMUM QUALIFICATIONS: All applicants must be admitted to the Virgin Islands Bar Association and licensed to practice in the Virgin Islands.
