GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission CONSOLIDATED COMPLAINTS OF Docket No. 667 TIER1 ACCESS, LLC AND LEVEL 3 Order No. §5/2018 COMMUNICATIONS ST. CROIX, INC, d/b/a “CenturyLink” v. VIRGIN ISLANDS TELEPHONE CORPORATION, d/b/a “Viya” ORDER WHEREAS, on April 4, 2018 the Virgin Islands Public Services Commission (hereinafter “Commission” or “PSC”) received a complaint from Tier! Access, LLC (hereinafter “Tier1”) complaint against the Virgin Islands Telephone Corporation (hereinafter VITELCO, d/b/a “Viya’”); and WHEREAS, on April 23, 2018, Viya responded to Tier!’s complaint; and WHEREAS, on May 2, 2018, Level 3 Communications St. Croix, Inc. d/b/a CenturyLink (hereinafter “Level 3°’) filed a complaint against Viya; and WHEREAS, on May 17, 2018, Viya responded to Level 3’s complaint; and WHEREAS, on June | 1, 2018, the parties submitted a Consent Motion for Continuance, asking that this matter be continued to the Commission’s next regularly scheduled meeting; and WHEREAS, on June 15, 2018, the Commission held a regular meeting at its office located at No. 1003 Estate Ross, Barbe! Plaza on St. Thomas, United States Virgin Islands and at the Virgin Islands Port Authority Conference Room on St. Croix, United States Virgin Islands; and WHEREAS, the Commission voted to accept Century Link’s Consent Motion for Continuance until the PSC’s next scheduled meeting; and WHEREAS, on August 15, 2018, the parties submitted a Joint Statement and Consent Motion for Continuance, notifying the Commission of the status of negotiations between the parties in this matter and asking that this matter be continued to the Commission’s next regularly scheduled meeting; and
