GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE: ) ) Docket No. 684 APPLICATION OF DEEPWATER PRODUCERS, INC. ) Order No. 25/2021 FOR SMALL POWER AND CO-GENERATION ) PRODUCTION CERTIFICATION FOR ST. THOMAS ) WASTE-TO-ENERGY ) ______________________________________________________) ORDER WHEREAS, on April 16, 2021, the Virgin Islands Public Services Commission (hereinafter “Commission” or “PSC”) received an Application from Deepwater Producers, Inc. (hereinafter “DPI”) requesting certification as Qualified Facility (hereinafter “QF”) on St. Thomas, United States Virgin Islands (hereinafter “USVI”); and WHEREAS, DPI is an energy project development company that is seeking QF certification to pursue a waste-to-energy development on the island of St. Thomas, in order to establish a Power Purchase Agreement with the Virgin Islands Water and Power Authority; and WHEREAS, DPI will also need to develop an agreement with the Virgin Islands Waste Management Authority to secure the necessary waste stream; and WHEREAS, on August 16, 2021, the Commission received a Report and Recommendations from its Technical Consultant, Georgetown Consulting Group, Inc. (hereinafter “GCG”); and WHEREAS, on August 17, 2021, the Commission met in regular session at its office on St. Thomas, USVI located at No. 1003 Estate Ross, Suite 4 and via its Zoom videoconference link; and WHEREAS, after review and deliberation, the Commission voted to GRANT DPI certification as a QF on St. Thomas USVI, subject to the recommendations included in the GCG report and to ACCEPT GCG’s Report and Recommendations; and NOW THEREFORE, the Commission finds and ORDERS that, DPI’s Application for certification as a QF on St. Thomas USVI is GRANTED on the following condition: PSC Order No. 25/2021 Docket 684: Deepwater Producers, Inc. Application for Q Certification 1. DPI must provide semi-annual reporting on the development of the Project including the status of power sales, purchase, and interconnection agreements, permitting, financing and construction.
