SHORT TITLE. 1 This Act may be cited as the ‘‘District of Columbia 2 and United States Territories Circulating Quarter Dollar 3 Program Act’’. 4 SEC. 2. ISSUANCE OF REDESIGNED QUARTER DOLLARS 5 HONORING THE DISTRICT OF COLUMBIA AND 6 EACH OF THE TERRITORIES. 7 Section 5112 of title 31, United States Code, is 8 amended by adding at the end the following new sub- 9 section: 10 ‘‘(r) REDESIGN AND ISSUANCE OF CIRCULATING 11 QUARTER DOLLAR HONORING THE DISTRICT OF COLUM- 12 BIA AND EACH OF THE TERRITORIES.— 13 ‘‘(1) REDESIGN IN 2009.— 14 ‘‘(A) IN GENERAL.—Notwithstanding the 15 fourth sentence of subsection (d)(1) and sub- 16 section (d)(2) and subject to paragraph (6)(B), 17 quarter dollar coins issued during 2009, shall 18 have designs on the reverse side selected in ac- 19 cordance with this subsection which are em- 20 blematic of the District of Columbia and the 21 territories. 22 ‘‘(B) FLEXIBILITY WITH REGARD TO 23 PLACEMENT OF INSCRIPTIONS.—Notwith- 24 standing subsection (d)(1), the Secretary may 25 VerDate Aug 31 2005 02:36 Dec 13, 2006 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3885.RDS H3885 hmoore on PROD1PC68 with HMBILLS 3 HR 3885 RDS select a design for quarter dollars issued during 1 2009 in which— 2 ‘‘(i) the inscription described in the 3 second sentence of subsection (d)(1) ap- 4 pears on the reverse side of any such quar- 5 ter dollars; and 6 ‘‘(ii) any inscription described in the 7 third sentence of subsection (d)(1) or the 8 designation of the value of the coin ap- 9 pears on the obverse side of any such quar- 10 ter dollars. 11 ‘‘(2) SINGLE DISTRICT OR TERRITORY DE- 12 SIGN.—The design on the reverse side of each quar- 13 ter dollar issued during 2009 shall be emblematic of 14 one of the following: The District of Columbia, the 15 Commonwealth of Puerto Rico, Guam, American 16 Samoa, the United States Virgin Islands, and the 17 Commonwealth of the Northern Mariana Islands. 18 ‘‘(3) SELECTION OF DESIGN.— 19 ‘‘(A) IN GENERAL.—Each of the 6 designs 20 required under this subsection for quarter dol- 21 lars shall be— 22 ‘‘(i) selected by the Secretary after 23 consultation with— 24 VerDate Aug 31 2005 02:36 Dec 13, 2006 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3885.RDS H3885 hmoore on PROD1PC68 with HMBILLS 4 HR 3885 RDS ‘‘(I) the chief executive of the 1 District of Columbia or the territory 2 being honored, or such other officials 3 or group as the chief executive officer 4 of the District of Columbia or the ter- 5 ritory may designate for such purpose; 6 and 7 ‘‘(II) the Commission of Fine 8 Arts; and 9 ‘‘(ii) reviewed by the Citizens Coinage 10 Advisory Committee. 11 ‘‘(B) SELECTION AND APPROVAL PROC- 12 ESS.—Designs for quarter dollars may be sub- 13 mitted in accordance with the design selection 14 and approval process developed by the Sec- 15 retary in the sole discretion of the Secretary. 16 ‘‘(C) PARTICIPATION.—The Secretary may 17 include participation by District or territorial 18 officials, artists from the District of Columbia 19 or the territory, engravers of the United States 20 Mint, and members of the general public. 21 ‘‘(D) STANDARDS.—Because it is impor- 22 tant that the Nation’s coinage and currency 23 bear dignified designs of which the citizens of 24 the United States can be proud, the Secretary 25 VerDate Aug 31 2005 02:36 Dec 13, 2006 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3885.RDS H3885 hmoore on PROD1PC68 with HMBILLS 5 HR 3885 RDS shall not select any frivolous or inappropriate 1 design for any quarter dollar minted under this 2 subsection. 3 ‘‘(E) PROHIBITION ON CERTAIN REP- 4 RESENTATIONS.—No head and shoulders por- 5 trait or bust of any person, living or dead, and 6 no portrait of a living person may be included 7 in the design of any quarter dollar under this 8 subsection. 9 ‘‘(4) TREATMENT AS NUMISMATIC ITEMS.—For 10 purposes of sections 5134 and 5136, all coins mint- 11 ed under this subsection shall be considered to be 12 numismatic items. 13 ‘‘(5) ISSUANCE.— 14 ‘‘(A) QUALITY OF COINS.—The Secretary 15 may mint and issue such number of quarter 16 dollars of each design selected under paragraph 17 (4) in uncirculated and proof qualities as the 18 Secretary determines to be appropriate. 19 ‘‘(B) SILVER COINS.—Notwithstanding 20 subsection (b), the Secretary may mint and 21 issue such number of quarter dollars of each 22 design selected under paragraph (4) as the Sec- 23 retary determines to be appropriate, with a con- 24 tent of 90 percent silver and 10 percent copper. 25 VerDate Aug 31 2005 02:36 Dec 13, 2006 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3885.RDS H3885 hmoore on PROD1PC68 with HMBILLS 6 HR 3885 RDS ‘‘(C) TIMING AND ORDER OF ISSUANCE.— 1 Coins minted under this subsection honoring 2 the District of Columbia and each of the terri- 3 tories shall be issued in equal sequential inter- 4 vals during 2009 in the following order: the 5 District of Columbia, the Commonwealth of 6 Puerto Rico, Guam, American Samoa, the 7 United States Virgin Islands, and the Common- 8 wealth of the Northern Mariana Islands. 9 ‘‘(6) OTHER PROVISIONS.— 10 ‘‘(A) APPLICATION IN EVENT OF ADMIS- 11 SION AS A STATE.—If the District of Columbia 12 or any territory becomes a State before the end 13 of the 10-year period referred to in subsection 14 (l)(1), subsection (l)(7) shall apply, and this 15 subsection shall not apply, with respect to such 16 State. 17 ‘‘(B) APPLICATION IN EVENT OF INDE- 18 PENDENCE.—If any territory becomes inde- 19 pendent or otherwise ceases to be a territory or 20 possession of the United States before quarter 21 dollars bearing designs which are emblematic of 22 such territory are minted pursuant to this sub- 23 section, this subsection shall cease to apply with 24 respect to such territory. 25 VerDate Aug 31 2005 02:36 Dec 13, 2006 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H3885.RDS H3885 hmoore on PROD1PC68 with HMBILLS 7 HR 3885 RDS ‘‘(7) TERRITORY DEFINED.—For purposes of 1 this subsection, the term ‘territory’ means the Com- 2 monwealth of Puerto Rico, Guam, American Samoa, 3 the United States Virgin Islands, and the Common- 4 wealth of the Northern Mariana Islands.’’. 5 December 9 (legislative day, December 8), 2006.
