IN-STATE TUITION FOR CERTAIN RESIDENTS OF 4 GUAM, THE COMMONWEALTH OF THE 5 NORTHERN MARIANA ISLANDS, AMERICAN 6 SAMOA, AND THE UNITED STATES VIRGIN IS- 7 LANDS. 8 (a) IN-STATE TUITION RATES.—Part C of title I of 9 the Higher Education Act of 1965 (20 U.S.C. 1015 et 10 seq.) is amended by inserting after section 135 the fol- 11 lowing: 12 ‘‘SEC. 135A. IN-STATE TUITION RATES FOR CERTAIN RESI- 13 DENTS OF GUAM, THE COMMONWEALTH OF 14 THE NORTHERN MARIANA ISLANDS, AMER- 15 ICAN SAMOA, AND THE UNITED STATES VIR- 16 GIN ISLANDS. 17 ‘‘(a) IN GENERAL.—A public institution of higher 18 education that receives assistance under this Act shall not 19 charge a covered individual tuition or fees for attendance 20 at such institution at a rate that is greater than the rate 21 charged for residents of the State in which such institution 22 is located. 23 ‘‘(b) COVERED INDIVIDUAL.—In this section, the 24 term ‘covered individual’ means an individual who— 25 VerDate Sep 11 2014 22:14 Mar 09, 2026 Jkt 069200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6472.RFS H6472 ssavage on LAPJG3WLY3PROD with BILLS 3 HR 6472 RFS ‘‘(1) is a resident of Guam, the Commonwealth 1 of the Northern Mariana Islands, American Samoa, 2 or the United States Virgin Islands; and 3 ‘‘(2) is a national of the United States (as such 4 term is defined in section 101(a) of the Immigration 5 and Nationality Act (8 U.S.C. 1101(a))).’’. 6 (b) PROGRAM PARTICIPATION AGREEMENT.—Section 7 487(a) of the Higher Education Act of 1965 (20 U.S.C. 8 1094(a)) is amended by adding at the end the following: 9 ‘‘(30) The institution will comply with the re- 10 quirements of section 135A, as applicable.’’. 11 Passed the House of Representatives March 4, 2026.
