COMMITTEE ON BUDGET, APPROPRIATIONS AND FINANCE 11/19/2024-REPORTED OUT TO THE FLOOR 11/14/2024-REPORTED OUT TO THE COMMITTEE ON RULES AND JUDICIARY BILL NO. 35-0387 Thirty-Fifth Legislature of the Virgin Islands October 4, 2024 An Act approving the multi-year lease agreement between the United States of America by and through the Department of Transportation Federal Aviation Administration and the Government of the Virgin Islands, acting through its Commissioner of the Department of Property and Procurement, for Plot No. 10 Estate White Lady, West End Quarter, St. Croix, Virgin Islands to be used for the continued operation of a Locator Outer Marker and Federal Aviation Administration activities in support of the National Airspace System, and for other related purposes PROPOSED BY: Senators Novelle E. Francis, Jr., and Dwayne M. DeGraff by Request of the Governor WHEREAS, on September 23, 2024, the Governor of the Virgin Islands approved the 1 lease agreement between the United States of America and the Government of the Virgin 2 Islands for a 20-year term; 3 WHEREAS, the United States of America will be leasing Plot No. 10 Estate White Lady, 4 West End Quarter, St. Croix, Virgin Islands, consisting of approximately 0.24 U.S. acres, as 5 shown on Public Works Registration No. 2015, dated October 31, 1966, for the continued 6 operation of a Locator Outer Marker and Federal Aviation Administration activities in support 7 of the National Airspace System, and for other related purposes; 8 WHEREAS, there is no monetary consideration to be paid by the Government of the 9 United States of America to lease the Premises as it is mutually agreed that the rights extended 10 to the Government of the Virgin Islands are in consideration of the obligations it assumes in its 11 establishment, operation, and maintenance of facilities upon the Premises; and 12 2 WHEREAS, title 31 Virgin Islands Code, chapter 21, section 205, subsection (c) 1 provides that in addition to the Governor’s approval of any lease, the Legislature of the Virgin 2 Islands must approve all leases exceeding a term of one year; Now, Therefore, 3 Be it enacted by the Legislature of the Virgin Islands: 4 SECTION 1. Pursuant to title 31 Virgin Islands Code, section 205, subsection (c), the 5 Legislature of the Virgin Islands approves the lease agreement between the United States of 6 America, acting by and through the Department of Transportation Federal Aviation 7 Administration and the Government of the Virgin Islands, acting through its Commissioner of 8 the Virgin Islands Department of Property and Procurement, for Plot No. 10 White Lady, West 9 End Quarter, St. Croix, Virgin Islands, consisting of approximately 0.24 acres, as shown on 10 Public Works Registration No. 2015, dated October 31, 1966, for a term of 20 years with no 11 monetary consideration, to be used for the continued operation of a Locator Outer Marker and 12 Federal Aviation Administration activities in support of the National Airspace System, and for 13 other related purposes. 14 BILL SUMMARY 15 This bill approves the multi-year lease agreement between the United States of America 16 and the Government of the Virgin Islands. 17 BR24-1342/October 3, 2024/LMW 18 G35-090 19
