Francis, Jr. WHEREAS, on May 17, 2022, the Governor of the Virgin Islands approved the lease 1 agreement between the Government of the Virgin Islands and the Virgin Islands Water and 2 Power Authority; 3 WHEREAS, the Virgin Islands Water and Power Authority will be leasing two (2) 4 portions of Remainder of Parcel No. I-A Estate Bovoni, Nos. 1 and 2, Frenchman’s Bay 5 Quarter, St. Thomas, United States Virgin Islands, consisting of approximately 108,900 U.S. 6 sq. ft. or 2.5 U.S. acres of land more or less, zoned P, two (2) portions of Parcel No. IA-S Estate 7 Bovoni, Nos. I and 2, Frenchman’s Bay Quarter, St. Thomas, United States Virgin Islands, 8 consisting of approximately 108,900 U.S. sq. ft. or 2.5 U.S. acres of land more or less, zoned 9 P, a portion of Parcel No. IA-7, Estate Bovoni, Nos. 1 and 2, Frenchman’s Bay Quarter, St. 10 Thomas, United States Virgin Islands, consisting of approximately 54,450 U.S. sq. ft. or 1.25 11 2 U.S. acres of land more or less, zoned P, a portion of Parcel No. 1-21 Estate Bovoni, Nos. I and 1 2, Frenchman’s Bay Quarter, St. Thomas, United States Virgin Islands, consisting of 2 approximately 54,450 U.S. sq. ft. or 1.25 U.S. acres of land more or less, zoned P, and Parcel 3 No. 17A-7 Estate Bovoni, Nos. 1 and 2, Frenchman’s Bay Quarter, St. Thomas, United States 4 Virgin Islands, consisting of approximately 43,849 U.S. sq. ft. or 1.007 U.S. acres of land more 5 or less, zoned P. The leased land will be used for the purpose of constructing, operating, and 6 maintaining wind turbine generators, maintenance sheds and access roads, and for constructing, 7 operating, and maintaining an electrical supply substation as part of a microgrid, and for other 8 related purposes; 9 WHEREAS, the rent will be $48,000, per annum, payable annually; and 10 WHEREAS, title 31 Virgin Islands Code, chapter 21, section 205, subsection (c) 11 provides that in addition to the Governor’s approval of any lease, the Legislature of the Virgin 12 Islands must approve all leases exceeding a term of one year; Now, Therefore, 13 Be it enacted by the Legislature of the Virgin Islands: 14 SECTION 1. Pursuant to title 31 Virgin Islands Code, section 205, subsection (c), the 15 Legislature of the Virgin Islands approves the lease agreement between the Government of the 16 Virgin Islands, acting through its Commissioner of the Virgin Islands Department of Property 17 and Procurement and the Virgin Islands Water and Power Authority for a term of 25 years with 18 the annual rent of $48,000, for the purpose of constructing, operating, and maintaining wind 19 turbine generators, maintenance sheds and access roads, and for constructing, operating, and 20 maintaining an electrical supply substation as part of a microgrid, and for other related 21 purposes. 22 BILL SUMMARY 23 This bill approves the lease agreement between the Government of the Virgin Islands 24 and the Virgin Islands Water and Power Authority. 25 3 BR23-0317/March 29, 2023/PFA 1
