R. 4005 AN ACT To provide for a circulating quarter dollar coin program to commemorate the District of Columbia, the Common- wealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands, and for other purposes. 2 •HR 4005 EH Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘District of Columbia 4 and United States Territories Circulating Quarter Dollar 5 Program Act’’. 6 SEC. 2. ISSUANCE OF REDESIGNED QUARTER DOLLARS 7 COMMEMORATING THE DISTRICT OF COLUM- 8 BIA AND EACH OF THE TERRITORIES. 9 Section 5112 of title 31, United States Code, is 10 amended by inserting after subsection (m) the following 11 new subsection: 12 ‘‘(n) REDESIGN AND ISSUANCE OF CIRCULATING 13 QUARTER DOLLAR COMMEMORATING THE DISTRICT OF 14 COLUMBIA AND EACH OF THE TERRITORIES.— 15 ‘‘(1) REDESIGN IN 2009.— 16 ‘‘(A) IN GENERAL.—Notwithstanding the 17 fourth sentence of subsection (d)(1) and sub- 18 section (d)(2) and subject to paragraph (6)(B), 19 quarter dollar coins issued during 2009, shall 20 have designs on the reverse side selected in ac- 21 cordance with this subsection which are em- 22 blematic of the District of Columbia and the 23 territories. 24 3 •HR 4005 EH ‘‘(B) FLEXIBILITY WITH REGARD TO 1 PLACEMENT OF INSCRIPTIONS.—Notwith- 2 standing subsection (d)(1), the Secretary may 3 select a design for quarter dollars issued during 4 2009 in which— 5 (i) the inscription described in the sec- 6 ond sentence of subsection (d)(1) appears 7 on the reverse side of any such quarter 8 dollars; and 9 (ii) any inscription described in the 10 third sentence of subsection (d)(1) or the 11 designation of the value of the coin ap- 12 pears on the obverse side of any such quar- 13 ter dollars. 14 ‘‘(2) SINGLE DISTRICT OR TERRITORY DE- 15 SIGN.—The design on the reverse side of each quar- 16 ter dollar issued during 2009 shall be emblematic of 17 one of the following: The District of Columbia, the 18 Commonwealth of Puerto Rico, Guam, American 19 Samoa, the United States Virgin Islands, and the 20 Commonwealth of the Northern Mariana Islands. 21 ‘‘(3) SELECTION OF DESIGN.— 22 ‘‘(A) IN GENERAL.—Each of the 6 designs 23 required under this subsection for quarter dol- 24 4 •HR 4005 EH lars shall be selected by the Secretary after con- 1 sultation with— 2 ‘‘(i) the chief executive of the District 3 of Columbia or the territory being com- 4 memorated, or such other officials or 5 group as the chief executive officer of the 6 District of Columbia or the territory may 7 designate for such purpose; and 8 ‘‘(ii) the Commission of Fine Arts. 9 ‘‘(B) SELECTION AND APPROVAL PROC- 10 ESS.—Designs for quarter dollars may be sub- 11 mitted in accordance with the design selection 12 and approval process developed by the Sec- 13 retary in the sole discretion of the Secretary. 14 ‘‘(C) PARTICIPATION.—The Secretary may 15 include participation by District or territorial 16 officials, artists from the District of Columbia 17 or the territory, engravers of the United States 18 Mint, and members of the general public. 19 ‘‘(D) STANDARDS.—Because it is impor- 20 tant that the Nation’s coinage and currency 21 bear dignified designs of which the citizens of 22 the United States can be proud, the Secretary 23 shall not select any frivolous or inappropriate 24 5 •HR 4005 EH design for any quarter dollar minted under this 1 subsection. 2 ‘‘(E) PROHIBITION ON CERTAIN REP- 3 RESENTATIONS.—No head and shoulders por- 4 trait or bust of any person, living or dead, and 5 no portrait of a living person may be included 6 in the design of any quarter dollar under this 7 subsection. 8 ‘‘(4) TREATMENT AS NUMISMATIC ITEMS.—For 9 purposes of sections 5134 and 5136, all coins mint- 10 ed under this subsection shall be considered to be 11 numismatic items. 12 ‘‘(5) ISSUANCE.— 13 ‘‘(A) QUALITY OF COINS.—The Secretary 14 may mint and issue such number of quarter 15 dollars of each design selected under paragraph 16 (4) in uncirculated and proof qualities as the 17 Secretary determines to be appropriate. 18 ‘‘(B) SILVER COINS.—Notwithstanding 19 subsection (b), the Secretary may mint and 20 issue such number of quarter dollars of each 21 design selected under paragraph (4) as the Sec- 22 retary determines to be appropriate, with a con- 23 tent of 90 percent silver and 10 percent copper. 24 6 •HR 4005 EH ‘‘(C) SOURCES OF BULLION.—The Sec- 1 retary shall obtain silver for minting coins 2 under subparagraph (B) from available re- 3 sources, including stockpiles established under 4 the Strategic and Critical Materials Stock Pil- 5 ing Act. 6 ‘‘(D) TIMING AND ORDER OF ISSUANCE.— 7 Coins minted under this subsection commemo- 8 rating the District of Columbia and each of the 9 territories shall be issued in equal sequential in- 10 tervals during 2009 in the following order: the 11 District of Columbia, the Commonwealth of 12 Puerto Rico, Guam, American Samoa, the 13 United States Virgin Islands, and the Common- 14 wealth of the Northern Mariana Islands. 15 ‘‘(6) OTHER PROVISIONS.— 16 ‘‘(A) APPLICATION IN EVENT OF ADMIS- 17 SION AS A STATE.—If the District of Columbia 18 or any territory becomes a State before the end 19 of the 10-year period referred to in subsection 20 (l)(1), subsection (l)(7) shall apply, and this 21 subsection shall not apply, with respect to such 22 State. 23 ‘‘(B) APPLICATION IN EVENT OF INDE- 24 PENDENCE.—If any territory becomes inde- 25 7 •HR 4005 EH pendent or otherwise ceases to be a territory or 1 possession of the United States before quarter 2 dollars bearing designs which are emblematic of 3 such territory are minted pursuant to this sub- 4 section, this subsection shall cease to apply with 5 respect to such territory. 6 ‘‘(7) TERRITORY DEFINED.—For purposes of 7 this subsection, the term ‘territory’ means the Com- 8 monwealth of Puerto Rico, Guam, American Samoa, 9 the United States Virgin Islands, and the Common- 10 wealth of the Northern Mariana Islands.’’. 11 Passed the House of Representatives October 7, 2002.
