On December 5th, last year, 2024, I participated in a BICC hearing to address patrons' a patron's formal complaint. January 18, 2025, participated in a bid review meeting for the replacement of the commission's AC condensing units. January 21, 2025, participated in the Department of Federal Emergency Management Agency recovery transition meeting the official closeout of the small capital grant funding for expenses incurred by the commission during hurricane urma and maria 2017. january 22nd 2025 participated in employee performance evaluations and january 23rd 2025 participated in a staff evaluation assessment meeting January 23, 2025, I chaired the first meeting of BICC's 30th Anniversary Celebration Committee. 0:06:50 This year-long celebration of community-based events and activities will be held through our territory to commemorate the Berlin Islands Casino and Resort Control Act of 1995. That is the legal frame of governing the casino on the result of the election. In January 24, 2025, participated once again in employee performance evaluations. January 31, 2025, participated in VICC executive meeting number 001-2025, where I was elected as VICC Secretary of Interior by unanimous book. February 4th, 2025 attended the VICC general staff meeting and participated in the discussion of the submission of the committee's FY 2024 annual report and the commission's achievement of attaining unmodified designation for the VICC fy 22 2022 audit results this is the second consecutive year the commission has been granted an unmodified designation february 14 2025 participated again in employee performance evaluations march 6 2025 participated in a draft review meeting for online gaming and internet That's what's better with the innovation group. Thank you, Commissioner McNary. 0:08:17 Director David, Judge Barnes, Mr. Capers, 2025, 30th year of the casino control commission and those uh a couple of you may have been there from uh from the exception you know so yeah i'm playing here we uh planned to let the public know that we've been here for the year right moving on to doing good things yes thank you Mr Chairman for my report during the same reporting period November 21st 2024 to March 12 2025 my report is in our packet I'd like to just highlight some of the activities uh a particular note i drafted and submitted a proposal entitled we have a story to tell the virgin honest casino control commission and the building of culturally adaptive problem gambling awareness initiative and this was submitted to the national american gaming regulators association the proposal i'm happy to say was accepted for presentation at the 2025 nagra education and training conference that's scheduled for june 1st of 2025 in nashville tennessee the presenters of that will include the chairman mr pikran deputy commissioner renaud steel from the department of health and myself and that presentation will focus on where we have we go to seminars and 0:10:07 conferences and different trainings concerning problem gambling that it's been made aware you've been made aware that it has to be cited it has to focus on the culture where the gambler is coming from to be able to be effective you have to understand why culture is impacting the gambler's choices how he views or he he or she use gambling and then be able to then tailor the treatment in our way and in this time period the commission with different things we were doing we did a rager ad where we went in and we changed the radio ad was voice which you know they call it elevator music and just a generic voice and we realized because chelsea brought it to our attention that may not be speak to the local residents so we went back voicing with a person a local um because a local person and and and adequate then use it and that announced our launch for playwise vi.org but that's what the conference our presentation at that conference will be the things that we have realized we need to adopt for a population predominantly black in the caribbean three small islands that maybe what we do on the mainland in the mainland united states the one incumbent what 800 gambler and the different resources while good may not be affected and also what led us to partner with the division of health with that memorandum of understanding to say we have to have counselors located in the territory we provided for three on each island district who can understand knows the community for where the gang is coming from or the family that needs help and then tailor the treatment in that matter so it can be effective and so that's what our presentation will focus on what we have been doing at the commission to try as far as what part of our mandate to provide programs that address problem 0:12:02 Machine transcript · UNVERIFIED. addiction um so i was very happy with that um we worked really hard in that presentation and just the fact that you were accepted by nagra to be a presenter at that tournaments um i also participated in patron license and hearings participated in the staff performance evaluations my colleagues elected me by share for one year term thank you colleagues attended a general staff meeting participated in issues affecting the other in the building the air conditioning and other items and then finally participated in review of the online game and expansion reports prepared by the innovative group so mr chairman i'm talking please my report and my activities for the period thank you very much chair and um it was stated earlier we have commission doing good things if i may say so myself and uh you mentioned the fact of that that ad uh and you know we have our executive meetings uh where we discuss you know a number of things and when we when we uh preview that that that particular idea you're talking about you know and um council reading um uh maybe i didn't like what you said but we listened you know yes we did we listened to our staff you know and if we have uh you know always listen you have to accept it and that was a very good one and um you know we went back and we thought yeah he has a point you know and especially if we are speaking about you know 0:14:41 culturally sensitive uh training um and we look forward to um to making our presentation because again we have uh we have a good story to tell uh and we're going to be doing it on national team you know so look forward to that so um chair chairman's uh report some activities have been mentioned by colleagues uh repeat them but uh december we uh convened a special between the hearing uh which was uh number procedure 3-2024 bgb versus uh mendoes which was a petition for removal from the exclusion list we um appeared at a press conference to sign the mlu with uh the bond of health uh commissioner that was our president about here was commissioner of health um uh commissioner pusta in cancion uh one of certain members of her staff our staff that was very important in the superior part not to be redundant but you know We recognize that there is some form of gambling addiction here in not just St. Croix, territory-wide. 0:16:35 and we have uh the commission has a mandate as was mentioned earlier to uh provide programs that would address them it's not that you know something we said you know you have uh you have uh you want to stop people from gambling no we don't want to stop people from down they have to realize that it's a form of entertainment you know when it becomes a problem you know the uh society suffers you know as uh and you've heard me say this before when i was in private life when i was uh we don't want people drinking more run right we don't want people drinking more about it we don't want people to gamble we want more people to gamble uh but we have to address that there are some and sometime ago um uh earlier on uh in my tenure here uh i remember mr cape was saying that we don't have the uh i don't want to put words here about with the empirical data in order to to know you know how many people are reaching out for help this website that uh vice chair mentioned playwise vi that all you know we have the capability to measure those analytics you know who uh who has visited uh that site how long they've been on the site et cetera et cetera you know so and i want to thank you um casino agencies for agreeing to put up the um posters you know your casinos we certainly certainly appreciate that we know that we are partners in this effort you know to address a problem and 0:18:28 responsible thank you um uh january uh 27th the state of the territory address where news was made at that state of the territory address um we mentioned the meeting with vendors uh regarding making of the ac uh we have a hearing uh with ranger american for the application for the renewal of non-gain included license convene the executive meeting office year 2025 to convene a meeting uh with the innovation group as i just mentioned earlier um we have uh on the statute we have the internet gaming gambling game act uh that's been on the books since 2001 2002 um sports betting internet gaming has taken off since uh 2018 uh in across the united states we've had that uh statute in our books since that time 2001 2002 those rooms and breaks uh along the statutes uh have been revisited we have some recommendations uh uh to those uh and we look forward to presenting uh those to 0:20:35 various stakeholders within their region and uh we commissioned a market impact analysis which was done by the commission group and the life that we plan uh uh with the next uh over the next uh 90 90 days or so to to have a summer we invite those stakeholders um the casino licenses of course um governor the general uh their key people the legislature and other interested parties and so we look forward to that and getting input um before we move on to the final stage which is to have the uh moving on to uh the financial matters and other related activities uh for the period october 1st 2024 through december 31st 2024 the commission issued a total of 46 licenses and statements of compliance in various categories as follows we have our casino employees seven casino key employees seven statement of compliance statements of compliance for casino employees 18 casino key employees 10 gaming related three and non-gaming related one for the same period issued 192 work permits 22 exemptions for licensure and 23 waivers and registration waivers from registration and licensure in regards to the international report of the commission when we had our meeting back in VI Update · usvipublicrecords.com · public record, no rights asserted (CC0 1.0) 3 of 8 Casino Control Commission (VICCC) · VICCC QUARTERLY MEETING & HEARING No 001 2025 031220 with two million five hundred forty thousand five hundred nine dollars versus budgeted projections of two million two hundred ninety four thousand five hundred dollars or 154 thousand nine dollars or 43 percent of the budget the major portion of good revenues came from the gbi for payroll and fringe benefits in the amount of one million or 53 percent of our revenue also where you notice the is that uh 554 417 dollars and 21.8 came from the commission's 25 share of the casino revenue fund you know the casino revenue fund was funded by the 12 percent tax paid by casino licensees on the gross casino revenue total expenses amounted to one million eight hundred thirty four thousand fifty nine dollars inclusive of inclusive of the one million three forty one uh nine hundred six dollars paid out for salaries and fringe for a surplus of seven hundred thirteen seven hundred dollars the current fiscal year 2025 to december 31st 2024 total revenue 11 to 467 thousand one hundred and four dollars with three hundred forty five thousand five hundred seventy dollars being the gbi's contribution for salaries and french expenses thus far inclusive of salaries and french amounted four hundred fifty one thousand i know the plus six dollars for a service of fifteen thousand one hundred ninety thousand as uh commissioner uh renee mentioned before we received our fiscal year 2022 audit 0:24:54 report from our auditors to a company uh that report was dated january 23 25 and for the second consecutive year we received an unqualified opinion um that in other words is a clean honor um the commission is very very proud of that accomplishment uh we worked hard and diligent to report to restore the uh public's confidence and trust in this agency and we made every attempt to continue to do so um i must mention this you know i i thought that um that was was a newsworthy event because we sent it out to the to the uh media and it was just one media outlet and i got into a little tussle with another media outlet about that but that's that's okay you know i i was reminded uh last year when we received uh such a such an audit uh my uh colleague to my left you know admonished me because i did not try to publicize that accomplishment i learned from that i did it you know who did it uh you know so but uh again you of thanks thanks to the team here at the airport commission um casino gross revenues uh for the period of october 21st october 1st 2024 to december 31st 2024 uh amounted to 4 million 0:26:50 $215,657 versus $4,640,768 for the same period last year an increase of $465,111 or roughly 10% for the entire fiscal year of 2024 total gross casino revenue amounted to 18 million 527 000 as mentioned before the gcr is taxed at a rate of 12 percent commission receives 25 the main 75 percent is allocated to support certain other government agencies other um casino licenses licensees employment stats the quarter ended december 31st 2024 both scenes reported a combined gross total payroll of 2 million 435 thousand 35 dollars with a total head count of 296 employees total payroll for the entire 2024 calendar year was 10 million 427 502 dollars with an average head count of 312 employees other spending for goods and services uh casino hotel licensees reported spending for other goods and services in the amount of five million it's recording five million one hundred sixty seven thousand nine hundred six dollars and which uh when compared to the same period last year of five million the two thousand three hundred sixty five dollars uh there was a slight increase of the five thousand forty one dollars or a little less than two percent examples of goods and services 0:28:48 include food liquor advertising insurance sleeping professional services etc etc the uh last uh item from my report matters of public interest as uh chairman of the commission i believe it is important to acknowledge for the record The Commission issued a license to BITL to operate a casino at the RBJ racetrack on April 19, 2024, after extensive investigations into the suitability of the applicants and two public hearings. The terms of the license was set for one year as provided by law on initial license. Again, as required by law, one of the conditions of the license was that construction of the casino was to commence within six months of receiving the license. As of October 19, 2024, BIGL had not commenced construction of the casino. During the Commission's regular meeting on November 20, 2024, BIGL was invited to provide a status update on the delay in construction. At that hearing, BIGL was advised that in accordance with the requirements of the CRCA, Casino and Regional Control Act, codified at 32, the VI code, 401, etc., it must formally request a six month extension of construction could not begin as planned. 0:30:55 The Commission would then decide once the statutory mandated investigation had been conducted by the DGE. a public hearing held whether the extension will be granted the igl that we submitted a request for a six-month extension on november 2nd november 22nd 2024 the commission received an investigative report on january 24 25 after review on february 6 2025 the commission issued an order scheduling a hearing for february 19th 2025 on january 27 2025 as i mentioned earlier during the annual state of the territory address governor brian jr announced that tony general of the vi had filed a complaint in the superior court of the vi against vigl seeking a ruling that vigl was in default of the franchise agreement to run horse races at the rdj racetrack on february 10 2025 the igl petitioned the commission to withdraw its request for the six-month extension to construct the casino at the rdj racetrack and to cancel the hearing scheduled for february 19 2025 due to ongoing settlement discussions between the igl and the government of virgin asm street bi the commission granted the igl's request by order dated 3rd 11th 2035 on march 5th 205 the igl announced by a press release that they have concluded their involvement in the rdj redevelopment project having reached an agreement with gvi to return stewardship of the rdj racetrack to the gvi as a result it was determined that the casino would not be constructed 0:32:45 Machine transcript · UNVERIFIED. VI Update · usvipublicrecords.com · public record, no rights asserted (CC0 1.0) 4 of 8 Casino Control Commission (VICCC) · VICCC QUARTERLY MEETING & HEARING No 001 2025 031220 at rdj racetrack by bigl the current law provides that only a holder of a horse racing franchise agreement can only operate a casino at the rbj race track consequently the license issued by the commission to bigl on april 19 2024 will expire april 19 2025 in a little more than 30 days the commission thanks bigl for its many many efforts to revive horse racing and gaming at the rbj restaurant and hopes that another applicant will soon present to the commission for a license to own it like the casino after the rbj airman and here it ends the chairman's report moving on to to director david good morning chair commissioners good morning all the members and staff and that they represent people who believe in the territory of the city uh basically uh i'd like to present the report of the for what was conducted by the original given enforcement from the period of november 1624 to march 425 0:34:39 One of the most important tasks that DGE is required to do is conduct due diligence investigation of every application. During that period, DGE completed due diligence investigations for seven customer service entity given related application applicants like qualifiers and one CKE application, the DGE also partially completed due diligence investigations of three qualifiers for casino service entity dealing with license applicants. During that same period, DGE closed off its investigation of nine applications, with applications that were terminated or applicants that were terminated or will resign prior to DGE completed the investigation. the DGE opened 48 new files applications received from the Casino Quantum Commission for various category of investigations from CHE, Casino Model Employees, up to Casino Services applications. I'd like to say that of the 48 within the past two months, the DGE received The DGE completed four investigations of technical complaints and submitted a report to the BICC for further action. The DGE is presently working on one investigation and that is submitted to the BICC shop. uh there's a second page to uh request for technical assistance during that period did you receive approximately 23 requests 0:36:29 for technical assistance from both DG and character individuals. DG staff assisted the gaming technicians and the individuals in addressing technical problems with EGMs who have these machines returned into the game before. And Nielan emphasized that the same staff that deals with the assistive technicians is the same staff as the investigations. So if we get a request with assist with the machine, whether it's new diligence or complete investigations, they'll have to stop that and concentrate on the system because that gives you that priority. 0:38:44 So whenever they fall, you're going to take a push. Because in my mind, if the voices are not . So that's what . So I just want to emphasize that . During that period of, as I just mentioned, the vg conducted a very extensive investigation of the uh of casino license uh licensee i should say we are eugenia with regard to the expedition for extension and we started some time in december and called for it and was able to drive over investigating the port of the company that it later so that the commission could set up this uh proposed area but we did uh quite a bit of food and everything together to provide that public commission in a timely manner so in the bg continues to provide training to all staff members both online and various conferences as the chairman mentioned um the chairman of the chairman and i are members of that ground planning committee and we test for you know how monthly meetings of that with regards for the for the members staffing and i don't know how many times i've said that but staffing is digi is major problem and presently digi had 317 applications we haven't touched on since i was going through and trying to um recognize that one was priority last week last month so let me just explain the way that we do it so that people have When we get the applications, I categorize them as to what I think is the most important and those are the least important. To me, if you get the CKD, the key employee line, this is important. So even though we might get this application from the year before, 0:39:23 that would have been priority. And we can stop that one from the year before, let's say it's a casino hotel employee and concentrate on the cka application so there was always rotating that situation suppose something that is new to consider upon whereby someone might say well i have an application in the for three years so the application might stay there with longer based on the new applications that we get based on the categorization of that So we have the casino game employees, the casino employees, we have the bottom of, we have the casino gaming regulated entities, and at the very bottom of the category of the casino hotel employees. We figured that they are not as, I don't say they're not as important, but I think it's more important to concentrate on folks in the casino that may run a jury or subscribe the decision so that we'll see exactly if there are any issues when we should get that continuity holding to the license. So that is the top category. This is a clean income. 0:41:34 So as indicated, there are 317 applications that are there. So we get into them, but very slow. NCI, I know I reported about the issues that we have at the NCI, getting the NCI support. And I met with David Chandler from the VIP in December. They are still having issues with the NCIC. However, within the past couple of months, she communicated with the FBI, and on a one-time basis, she was able to present the hard copies of the fingerprint card, which is not normal, and she called me, I think it was Saturday or something, and they processed this. 0:42:38 So we should be getting NCIC that was on the ground, requests that were submitted for the past six, seven months would be getting this. So we'll see a complete way that goes. So that the slow community should be getting effective this week. Primacy should be getting everything that was packed up. What are we trying to do? Let me just say here that I just want to open it on the process of how we operate. Even if we have, we have a CHP application, request the NCIC, NCIC, even if that application, the investigation for that application is at the lower end of the token code. If the NCI script shows that there is a criminal application, that application automatically rises to the top. So if you get the NCIS, you'll see exactly who that person was arrested for this, arrested for that, and we deal with that application, so the commission would be willing to do that, because it's still very diverse. So I just want to do that, that's why we're trying to handle the same situation. I would like to talk a little bit on something else briefly, and that is, I just want to. to thank both bb and caravan with regard to the compliance of the corporation that let me just say and i didn't have this opportunity to thank both mr kitless and mr shape for the corporation with vg which led to the successful completion of the compliance audits from the respective customers which resulted in the iccc's recent acceptance of the revisions the existing internal controls at both Carapel and DDE. As you all are aware, this process began about a year ago, when I returned to Spectrum, requesting a Spectrum conduct compliance audit of both casinos. In April 24, DDE entered into a contract with Spectrum to do just that. 0:44:30 Sunday after, DGE communicated to Mr. Capers and Mr. Schaefer to schedule an audit and to form them for documents that would be required by Spectrum. The vote was very accommodating, the audit was concluded and in July 2024, DGE transmitted copies of the audit to the respective to Mr. Capers and Mr. Schaefer for the review and comments of the audit. In September of 2024, DGS came in separate meetings with Mr. Capers, Schaefer and the Commissioners and staff of the CCC to discuss Spectrum's findings and recommendations. I recommended changes to the existing internal controls. Following that meeting, the BICCC engaged both with the Capers Administrative over a period of time to develop the necessary changes which result in the revision of the respective casinos existing controls. I began the process because strong internal controls are necessary, but I believe that strict adherence to these internal controls is important because the casino is operating in the manner that it tells the BICCC that it will operate which the BICCC accepts and expects the business to operate in that manner the end result is that there will be less investigations inside the DGE for non-compliance and therefore less complaints being fired against the business language so I just wanted to say thank you all and continue the revision of the internal that's basically what i have and i know i just want to say that uh mr chairman that in the last several months we have been working diligently to try to be a additional staff for bga we haven't got this so we're still where we are and um i'm exhausted that's all i can say I spoke to my boss recently, he said, I don't know what else to do, but it was very helpful trying to get it done. 0:45:50 But we're trying to do all we can, working with the commission to get things done.
