ACT NO.8 8 6 1 BILL NO. 35-0262 THIRTY-FIFTH LEGISLATURE OF THE VIRGIN ISLANDS Regular Session 2024 An Act appropriating $1,434,950 in fiscal year 2024 from the Community Facilities Trust Fund for the pre-construction soft costs to prepare the Charlotte Amalie harbor for dredging; making various appropriations; and establishing a new procedure for the payment of funeral expenses for veterans ---0--- Be it enacted by the Legislature of the Virgin Islands: SECTION 1. (a) The sum of $1,434,950 is appropriated in the fiscal year ending September 30, 2024 from the Community Facilities Trust Fund to the Virgin Islands Port Authority to finance pre-construction soft costs to prepare the Charlotte Amalie harbor for dredging. (b) The sum appropriated in subsection (a) remains available until expended. SECTION 2. Not later than 30 days after the enactment of this act, the Virgin Islands Port Authority shall provide to the Legislature of the Virgin Islands: (1) project timelines that include a schedule of completion of the pre-dredging activities for Charlotte Amalie Harbor; (2) aproject budget that indicates the use of all available and appropriated funding for the project, not to exceed the budget amount; and (3) a bi-monthly project report that includes staffing reports, accounting records and updated photos. SECTION 3. (a) Notwithstanding the use restriction set forth in 33 V.LC. § 3072(c), the sum of $15,000 is appropriated in the fiscal year ending September 30, 2024, from the Tourism Advertising Revolving Fund to the Virgin Islands Department of Sports, Parks and Recreation, to be used as a grant to the Helenites Sports Club, a local non-profit organization, to provide lodging, food, and transportation due to being unavoidably delayed returning to the Virgin Islands because of the CrowdStrike computer glitch that has affected airline travel in the United States. 2 (b) The Helenites Sports Club is subject to and must comply with the reporting requirements of title 2 Virgin Islands Code, section 29. SECTION 4. The amount appropriated in Act No. 8759, section 1, “C/CNTR MISCELLANEOUS ORGANIZATIONS” to “DHS CONTINUM OF CARE $ 185,000” remains available until expended. SECTION 5. Title 3 Virgin Islands Code, chapter 1, section 8b is amended: (a) _ by striking the language in subsections (a) and (b) and inserting new language to read: ‘“(a) The Government of the Virgin Islands shall pay $5,000 to a funeral home or a mortuary business that prepares the body of a veteran of the United States Armed Forces for burial, interment, or renders other services connected with the death upon the funeral home or mortuary business submittal of a certified copy of the death certificate and an invoice for services performed to the Office of Veterans Affairs. (b) The Director of the Office of Veterans Affairs shall develop the procedures for the implementation of the direct payment to the mortuary business or funeral home. SECTION 6. (a) The sum of $1,500,000 is appropriated in the fiscal year ending September 30, 2024 from the St. Croix Capital Improvement Fund to the Virgin Islands Department of Public Works, to purchase road clearing equipment, to fund road repairs on the island of St. Croix, and to complete the road repairs authorized under section 5 of Act No. 8770 on the following parcels of land: (1) Plot L to 4T Lower Love; (2) Road Parcels 215 and 216 in Estate Morningstar; (3) Estate LaGrande Princesse Plots 94-272; and (4) Contentment Road, St. Croix, Virgin Islands. (b) Of the sum appropriated in subsection (a), $250,000 must be used to purchase road clearing equipment. (c) The funds appropriated in subsection (a) must be expended not later than September 30, 2025. 3 Thus passed by the Legislature of the Virgin Islands on July 23, 2024.
