F/K/A AT&T Mobility USVI, Inc. GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission IN RE: ) ) Docket No. 670 AT&T MOBILITY USVI PETITION FOR ) Order No. 31/2022 ELIGIBLE TELECOMMUNICATIONS CARRIER ) DESIGNATION IN THE U.S. VIRGIN ISLANDS ) ______________________________________________________) ORDER WHEREAS, Liberty Mobile USVI, Inc. F/K/A AT&T Mobility USVI, Inc. (hereinafter “Liberty”) filed a request with the Virgin Islands Public Services Commission (hereinafter, “PSC” or the “Commission”) for recertification of its Universal Service Fund (hereinafter, “USF”) eligibility pursuant to section 54.314 (a) of the Federal Communications Commission (hereinafter “FCC”) rules; and WHEREAS, annual recertification of continued eligibility is required by the FCC; and WHEREAS, on September 2, 2022, the Commission conducted preliminary discussions with all parties regarding the USF recertification; and WHEREAS, on September 14, 2022, the Commission received a report and analysis from its technical consultants, Georgetown Consulting Group, Inc. (hereinafter “GCG”) recommending the approval of Liberty’s USF recertification; and WHEREAS, on September 26, 2022, the Commission met in regular session at its office on St. Thomas, US Virgin Islands, located at No. 1003 Estate Ross, Suite 4 and via its Zoom videoconference link; and WHEREAS, after review and deliberation, the Commission voted to GRANT Liberty recertification of its ETC status to include the following recommendations contained in the GCG Report; and NOW THEREFORE, the Commission finds and ORDERS that, Liberty’s designation as an Eligible Telecommunications Carrier in the United States Virgin Islands is RECERTIFIED on the following findings, terms and conditions: PSC Order No. 31/2022 Docket 670: Liberty Mobile USVI, Inc. F/K/A AT&T Mobility USVI, Inc. Eligible Telecommunications Carrier Designation in the U.S. Virgin Islands 1) Liberty must file concurrently with the USVI PSC any reports or waiver requests submitted to the FCC and USAC in connection with its Connect USVI Stage 2 Mobility award. 2) Until such time as the PSC grants relinquishment of its ETC designation, Liberty must annually file with the USVI PSC no later than July 15, of each respective year the number of Lifeline subscribers as well as the number of subscribers for any other similar- purposed low-income program such as the Affordable Connectivity Program So Ordered.
