PROCEEDINGS Or THE COLONIAL COUNCIL FOR ST. CROIX. Continued from yesterday’s Avis sth Appointed Member [Lunney] re- marked: Mr. Chairman. We have all been endeavoring since the American Government took over these islands to have a nev code of laws—|[Andersen: I object, the code of laws is nut' before the Councilitis the organization act we are discussing| Member Lunney contin- uing, Up to the present the people are .ot having any advantage taken of them:; the same laws that are before us today are working in Porto Rico and in the Philippines and the people of those is- lands are satisfied with them. There has never been a marked improvement made in any other country in such a short space of time as there has been in this island since the American occupation. If the laws are passed and it goes into effect and a man goes into court and there deprived of his rights, then it would be sufficient time to take objection. Able men were put on these laws to frame them and I see no reason why we should stand here finding petty faults with them. The Chairman would like to ask mem- bers to respect the Rules of Business and confine their remarks to third dis- cussion. 3rd Appointed Member (Armstrong) remarked. Mr. Chairman. 1 think it would be a good idea to bring for- NP oLI R A&V b & ward a suggestion. It would be best to have two District Judges, oue tor St. Thotmas and one for St. (roix and one police judge, the Yistrict Judge can live at one end and the Police Judge at the other end. The Chairman remarked. 1 wish to rgnind members that this matteg 1s before the House on 3rd Discussion. The Chairman further remarted: I wll read the Rules of Business wheYe it relates to 3rd Discussion so that members may be aware of their premises. The Honor- able Ist Member for Frederiksted Coun- try District, at the last meeting, proposed that 2nd Discussion be closed and now he is advising the Council to accept the organization. That’s puzzling As regard to the question of taxation the Congression il Commission in giving their farewell addresses, one of them laid great stress or this Uourcil passing these code of laws which is now before us; that sounds to me as if they recom- mend to this Couneil to organize its own system of taxation rather than go to Congress and ask to make laws for our* taxation down here [do not know of any place in the world where a tax of fiftee1 dollars is imposed on an acre of cultivated land. 1 as a tax-payer feel that we are paying all the taxes we can at present; if Our population con- tinue to decrease and we eontinue to have the dry weather we are now having it is going to be hard with the tax payers; it 18 necessary that we economize, but at the same time we should pass these laws; considering a Commitiee sat on them. sent in its report, and all amendments made by that Committee have been incorporatedIsee no reason why we should not pass the laws. I have heard it said that the laws now before the Council are very stringent. Gentlemen Idon’t kncw of any secrecy about this matter, legal minds have pass- ed upon these laws all the way through and every amendment that haS been proposed has been incorporated in the laws; I recommend that members vote for these code Os laws. The Chairman remarked: Honorable Members Government has brought in an amendment to Section 11, Chapter lof the bill. The Chairman read the amend- ment and said,—This amendment has been made to the bill in St. Thomas and Government desires that the same be made here. The amendment reads: AMENDMENT To Colonral Council Bill No. 29. 2nd Sessron 1919-1920 To section 11 of ¢ hapter 1 in Line 2 after the word Governor be added, ‘“‘and the respective Colo- nial Council.”” e FRED. The Chairman remarked: T isamend ment has just been handed to me, it is therefore necessary to have a three quarter vote of the Council as to whether it should be furthered today. Ist Member for Frederiksted ‘ountry District {Andersen) remarked: Mr. Chairman. 4th Appointed -Member tßlackwood) says that at the last meet- ing I recommend that 2nd Discussion on the laws be closed; I did not. The laws were not before the Council then, the or- ganization act was before us at that time. In regard ro taxation, I don’t think it unfair if the tax-payers have a say when it comes to such an expensive or- ganization as the one which is now be fore us. 4th Appointed Member (Blackwood) remarked: Mr. Chairman. 1 thought the Honorabie Member meant both law and organization when he made his motion, The Chairman remarked: Honorable Members the status of the matter is this, The amendment is broughtin bv Government and if it fails to get a three- quarter vote of the members present it cannot be furthered today: in other words, if you vote for the amendment it will not come woday, and if you vote against it means that you postpone the matter until the next meeting. Ist Member for Christiansted Country District [Stakemann] remarked: Mr. Chairman. Irecommend that the vote which is about to be taken to furth r the amendment be postponed, for the reas- on, there will be a meeting held by the community tomorrow evening in regard to this organization act and recommen- dations might be made to the Counecil and to Washington. . The Chairman put to the vote whether the amendment should be furthered to- day. 11 members voted for; 3 against four did not vote. . The Chairman remarked: As 14 votes are necessary to further this matter do- day the motion is lost and the amend- ment will be printed and circulated and wiil come up at the next meeting of the Council. Ist Member for Christiansted Country District [Stakemann] rematked: Mr. Chairman. In regard to the question as to whether we should have one or two judges, I hold that it is the right thing tc have two District Judges; we have nothing else to do but to follow the re- commendations made by the Congression- al Commission; that’s their recommend- ation and it isin accord with the pro- posal made here; if the Congressional Commlssion can make such a recom-
