Berry BE IT ENACTED by the Legislature of the Virgin Islands: SECTION 1. Title 32, Chapter 51, Section 64 is amended by adding subsection (e) to read as follows: “(e) All property including funds of the authority shall be exempt from attachment, levy and sale by virtue of an execution, and no execution or other judicial process shall issue against such property, nor shall any judgment against the Authority be a charge or lien upon its property.” OCOOAN ODA PAN = ooh 2 BILL SUMMARY The bill amends 32 V.I.C. § 64 by protecting the Magens Bay authority from judgment liens and executions against its property. Act No. 6333, Section 30 is amended on page 23, subsection (d), item seven: (a) delete “and” where it appears and insert in lieu thereof a comma; and (b) after “research material” insert, “and to fund capital projects”. EXPLANATION One million dollars was appropriated from the Youth Education and Training Endowment Fund for the fiscal year ending September 30, 2000 for the Department of Planning and Natural Resources. The purpose of the money was to purchase books, periodicals and research materials for the public libraries. The amendment will allow the money to be used for capital projects. The Public Transportation Enabling Fund ee (a) There is established in the Treasury of the Virgin Islands a fund designated as the Public Transportation Enabling Fund, referred to herein as the ‘Fund’. The Commissioner of Finance shall provide for the administration of the fund and shall promulgate rules and regulations governing the expenditure of funds and reporting requirements consistent with the provisions of this section. (b) The Fund shall consist of all sums appropriated to it by the Legislature of the Virgin Islands, all eligible federal funds, all donations, gifis and bequests, and all fare-box revenues venerated by the Virgin Islands Transit Authority; but the balance in the Fund may not exceed $100,000, during any fiscal year. (1) The imprest fund checking account may not exceed $50,000. (e) The Commissioner of Public Works and the Deputy Commissioner of the Office of Transportation shall be the sole certifying officers for vouchers or imprest fund checks for expenditures of monies from the Fund. The Commissioner of Public Works, not later than the 15" day of each month, shall submit a monthly report to the Commissioner of Finance which details the amount, nature and justification for each expenditure made during the previous month and includes receipts any other documents required by the Commissioner of Finance. (a) Title 32, is amended by adding a new Chapter 4 to read as follows: “CHAPTER 4. The Cramers Park Authority Section 71. Policy; purpose of Cramers Park Authority; corporate instrumentality (a) The Government of the United States Virgin Islands hereby declares that the welfare of the United States Virgin Islands and the improvement of the health and living standards of its people require that public use and development of park and beach areas be facilitated by the establishment of a public agency to plan and execute a continuing constructive program in this field of community recreation. (b) For the purpose of acquiring, improving and operating parks and beaches, the Cramers Park Authority which is established by title 3, section 308 of this code, is declared to constitute a corporate instrumentality of the Government of United States Virgin Islands. Section 72. Corporate powers and duties The Authority: (1) may purchase, lease, receive as a gift, and hold such real and personal property as it deems necessary in carrying out its functions under this chapter; (2) may adopt, amend and repeal bylaws; ms (3) may sue and be sued in its Authority name; (4) may hire and discharge employees as necessary to carry out its activities; (5) may make contracts as herein authorized; (6) may construct, maintain and operate bath houses and cabanas, piers, bridges, pumping stations, and such other structures and improvements as it may deem necessary; (7) shall make available to the public its bathing houses, beaches and other facilities and may charge such fees and rentals for the use of same, in proportion to their type and character as it may consider requisite; and (8) shall at all times in planning and landscaping its properties act with a view to preserving and enhancing their natural beauty. Section 73. Board of Directors The powers of the Authority shall be exercised by a Board of seven directors who shall be residents of the island of St. Croix. The initial appointment of members shall be two members appointed for two years, two members appointed for four years and three members appointed for six years. Thereafter, the term of each member of the Board shall be six years. All members shall be appointed by the Governor with the advice and consent of the Legislature, members shall be eligible for reappointment. They may be removed by the Governor for neglect of duty or malfeasance in office. Three members of the Board shall at all times constitute a quorum. At least four members of the Board shall have camped ut least five (5) years at Cramers Park. Section 74. ‘Expenses of Board The Board of Directors shall serve without compensation but shall receive a $50 per day per diem for each day or part thereof incurred in the exercise of their duties. Section 75. Manager; Treasurer The Board of Directors may employ a Manager to conduct the affairs of the Authority, supervise the construction of all buildings and operation of parks, beaches and structures and generally transact its business subject to the director of the Board and responsible to it. The financial affairs of the Authority shall be conducted by its Treasurer duly appointed in accordance with the bylaws of the Authority; said Treasurer shall be bonded in an amount determined by the Board. Section 76. Exemption from taxes; title to property The Authority shall not be required to pay any taxes or assessments on any property acquired by it for its purposes or on any income derived from any of its authorized activities. The Authority shall retain title to all real property within the park areas, except property owned by the Federal or Territorial Governments. Section 77. Activities, concessions and leases; ejection of persons The Authority may set up and operate activities within park areas as it deems desirable in the public interest, or if a majority of the members of the Board so vote, it may lease to provide individuals concessions within the area in conformity with rules and regulations prescribed by the Board. All leases granted within the park areas shall contain a cancellation clause in favor of the Authority, where the term may be cancelled, in the public interest, upon the violation of any rule or regulation by the lessee. This rule 2 shall apply also to all persons making temporary use of any of the facilities who, in case of improper conduct, may be ejected from the premises. Section 78. Rules and regulations The Authority is authorized to make rules and regulations and to adopt procedure, not in conflict with this chapter, for the operation, maintenance and construction of public facilities on the park areas, and for the conduct of visitors, patrons and the general public. Section 79. Penalty for violation of rules Whoever willfully vioiates Park Authority Rules after they have been posted by the Authority shall be fined not more than $25. Section 80. Obligations of government; mortgage of property; use of beaches (a) Nothing contained in this chapter shall authorize the Authority to obligate the Government of the United States Virgin Islands for any expenses incured over and beyond any moneys actually appropriated by the Government of the United States Virgin Islands, nor shall the Authority mortgage or similarly encumber any of its real property. (b) Nothing in this chapter shall be interpreted to mean that the full and proper use of any part of any beach by the public may be prohibited or restricted. The rights of all fishermen using any beach coming under the authority of the Cramers Park authority herein provided for shall continue inviolate. Section 81. Funds All funds acquired by the Authority from leases and other sources and all gifts and other monies acquired by the Authority shall constitute a fund for the purposes of this chapter and for no other purpose. Section 82. Jurisdiction of the Authority Notwithstanding any other provision of this chapter to the contrary, the juridiction of the Authority shall be limited to the properties described by public record as Cramers Park, St. Croix. Section 83. Applicability of other laws Nothing in this chapter shall be construed as exempting the Virgin Islands Cramers Park Authority from any law made specifically applicable thereto or generally applicable to independent instrumentalities of the Government of the United States Virgin Islands. Section 84. Limitations on liability (a) No judgment shall be rendered against the Cramers Park Authority in excess of $25,000 in any suit or action against the Authority with respect to any injury or loss of property or personal injury or death which: (1) may be caused by the negligent or wrongful act or omission of an employee of the Cramers Park Authority while acting within the scope of his employment under circumstances where the Cramers Park Authority, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occurred; or (2) may occur in connection with the use of Cramers Park Beach or its facilities. (b) The provisions of subsection (a) of this section shall not apply if the injury, loss of property or death is caused by the gross negligence of any employee of the Cramers Park Authority while acting within the scope of his employment. s (c) The Authority consents to have the liability determined in accordance with the same rule of law as is applied to actions in the courts of the United States Virgin Islands against individuals or corporations. Title 4, chapter 27, section 442, Virgin Islands Code is amended as follows: 1. Delete the title and first two paragraphs and insert in lieu thereof the subsequent paragraphs: “§ 442. The Judicial Council Imprest Account Notwithstanding any other law, the Judicial Council of the Virgin Islands (the “Judicial Council”) is authorized to establish a separate operating bank account to be known as the “Judicial Council Imprest Account” (the “Imprest Account”). The account shall also consist of all eligible federal funds, all donations, gifts and bequests, and other revenues designated to the Imprest Fund. The Chief Judge of the District Court shall provide for the administration of the account and shall promulgate rules and regulations governing the expenditure of funds consistent with the provisions of this section. All monies received by the Judicial Council shall be deposited into the Imprest Account, provided however, that of the $500.00 annual licensing fee required to be paid by each practicing attorney pursuant to title 27, section 302 of this Code the sum of $200.00 shall be made payable to the Judicial Council for deposit into the Imprest Account. The remaining $300.00 of said licensing fee shall be covered into the General L \ Fund of the Treasury of the Virgin Islands. ‘ at s ' » 2. The first sentence of the third paragraph is amended by deleting the words “Law Library Fund” and inserting in lieu thereof the words “Judicial Council Imprest Account”. EXPLANATION The purpose of creating a Judicial Council Imprest Account is to ensure the upkeep of the Law Library services. The present procedure requires all attorney licensing fees to be deposited into the General Fund. According to Judge Raymond Finch, as a result of the procedure, the council lost approximately three hundred thousand dollars ($300,000.00).
