AMENDMENT No. 1 OF SUPPLY CONTRACT NO. S054ADPWC21(BTTS) THIS AMENDMENT made as of the 19th _ day of _April , 2022 in the Territory of the Virgin Islands, by and between the Government of the Virgin Islands DEPARTMENT OF PROPERTY AND PROCUREMENT, on behalf of the DEPARTMENT OF PUBLIC WORKS (hereinafter referred to as “Government”) and Bates Trucking and Trash Removal, Inc. whose address is P.O. Box 834, Kingshill, VI 00851 (hereinafter referred to as “Contractor’). WITNESSETH WHEREAS, pursuant to Supply Contract No. S054ADPWC21(BTTS) approved by the Commissioner of Property and Procurement on August 13, 2021 and (which constitute and are hereinafter referred to as the “Contract’’”), the Government contracted with Contractor to provide Emergency Territorial and Federal Roadside Clearance on the Island of St. Croix, U.S. Virgin Islands; and WHEREAS, the Supply Contract expires pursuant to its terms on May 31, 2022; and WHEREAS, the parties desire to amend the Supply Contract, to extend the term of the contract to November 30, 2022 subject to the terms and conditions set forth below to ensure uninterrupted services during the hurricane season and natural disasters; and WHEREAS, the parties desire to amend the Supply Contract, to add a one (1) year renewal option, subject to the terms and conditions set forth below; NOW THEREFORE, for mutual and valuable consideration, the undersigned contracting parties agree to amend the Contract as follows: TERMS AND CONDITIONS 1. The Contract, is hereby amended by deleting all existing language contained in Section II and replacing it with language as follows: This Contract shall commence on June 1, 2021, and shall terminate on November 30, 2022, unless mutually extended or terminated by the Parties. The Government in its sole discretion will have the option to extend the services under this Contract for a one-year period commencing December_1, 2022 and terminating November 30, 2023. No alterations or variations of the terms of the proposal shall be valid or binding upon the Government unless made in writing and approved by the Government.
